• COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />14 June 2015 <br />Tom Bird, Manager of Coal Services <br />GCC Energy, LLC <br />6473 County Road 120 <br />Hesperus, CO 81326 <br />Re: King Coal Mine (Permit No. C-1981-035) <br />Technical Revision No. 24 (TR -24) - Response to Midterm Review <br />Preliminary Adequacy Review <br />Dear Mr. Bird: <br />The Division issued Midterm Review No. 7 (MT -07) for the King Coal Mine permit on February <br />18, 2015. In response to that review, which identified specific sections of the permit that <br />needed to be updated, GCC Energy, LLC (GCC) submitted an application for TR -24 on April 30, <br />2015. <br />The application was initially found Incomplete on May 5, 2015. The application form and <br />proposed public notice were then provided by GCC, and the application was deemed to be <br />Complete for purposes of filing on May 15, 2015. The Division issued notice of the application's <br />completeness to the following agencies / entities: the Office of Surface Mining (OSM); the <br />Bureau of Land Management (BLM); the Fish & Wildlife Service (USFWS); Division of Water <br />Resources (DWR); Colorado Parks and Wildlife (CPW); the State Board of Land Commissioners, <br />the State Office of Archeology & Historic Preservation (SHPO); the Southwestern Water <br />Conservation District; La Plata County Planning and Commissioners; and Danielson-Rainville <br />(attorney representing local residents). Responses were received from CPW and La Plata <br />County; copies are attached, for your reference. <br />GCC's public notice of the TR -24 application's filing was published in the May 24, 2015 edition <br />of The Durango Herald, as verified by Proof of Publication received on June 4, 2015. The period <br />for public comment extended through Monday, June 3, 2015. No comments were received. <br />The Division has reviewed the materials submitted under TR -24 (including an addendum <br />received on May 26, 2015) for adequacy with respect to the Rules and, specifically, with <br />comments itemized in Section VI of the February 18, 2015 Midterm Review.
