M -/99q- Or REDIFIVF-D <br />or -of <br />Letter of Notification and Request for Inspection JUN 12 2015 <br />To Whom It May Concern: DIVISION OF RECLAMATION <br />MWINGAND SAFETY <br />Aggregate Industries has negatively impacted our property in a significant way. <br />They have not properly taken precautions to prevent water overflow from their <br />mine onto my property, 13644 County Road 64, Greeley, CO 80631, Weld County. <br />My land borders the Aggregate Industries mine. I have been economically impacted. <br />When water levels of the Poudre River rise they do not crest and spill onto much of <br />my land. However, the river does completely flood Aggregate Industries mine pits to <br />my west. When the mine pits fill with water they gush significant amounts through a <br />gap in the burm (about 30 feet wide) and an uncontrolled and washed out culvert <br />(about 4 feet wide) separating my property from the mine. <br />The amount of water coming from Aggregate Industries mine from my west and <br />draining into the Poudre River to my east, has almost completely covered 13 of my <br />15 acres with water 26" deep in most spots for almost a month. It has also created a <br />steady stream of water turning my ponds into a creek and washing out the land <br />bridge that had been built up and improved by the farmers who are leasing my <br />property. <br />At this time we are unable to continue leasing our land for this season and have <br />refunded our lessees for May's rent because the land was unusable and not <br />accessible for much of the month. We did not charge them for June and put the lease <br />on hold indefinitely until] the problem can be fixed. These financial losses are <br />reflected in the attached lease. <br />I am seeking a permanent fix by Aggregate Industries to prevent unwanted water <br />overflow from their land to my land.
