Compliance With Mine Plan <br />N - Support Facilities Not On-site <br />N -Other <br />N - Special Categories Of Mining <br />NA - Processing Waste <br />N - Topsoil <br />COMMENTS <br />This complete inspection of Elk Creek Mine outside Sommerset, Colorado was conducted on Tuesday the <br />19th of May 2015. Ground conditions were damp and muddy in places especially on the roads. The day varried <br />from partly sunny and 62'F to occaisional rain. No snow was present. <br />Robin Reilley accompanied by Dan Hernandez both of the Division of Reclamation Mining and Safety (DRMS) <br />conducted the inspection. Doug Smith and Jim Kiger were present representing the mine. Jim and Doug <br />described the current "on the ground" conditions at the site, ongoing projects, preparation for auction of materials <br />and future permitting actions. The Bear Creek fan is in process of being dismantled and this area will be prepared <br />for reclamation and transfer of ownership. Permitting revisions are under consideration. <br />Oxbow is generating electricity from the methane capture systems. Some of the electricty is used on site and some <br />is sold to outside entities. Oxbow Mining LLC., made the decision to halt operations and sell off the equipment <br />through Iron Planet; http://www.ironplanct.com/. Items can be perused by going to the website and following the <br />instructions below: <br />From the Iron Planet web page click on 1) buy now link. 2) Search all equipment. <br />Under Type of Equipment select 3) Underground Mining. <br />This was a complete inspection with a focus on hydrology and revegetation progress. <br />SIGNS AND MARKERS Rule 4.02: <br />• Mine Identification signs and surface disturbance markers identified during this inspection were installed <br />as required throughout the areas visited. <br />• The East permit boundary sign is easy to miss as it is quite a ways down the highway on the North side <br />and 100 yards past the CDOT turnout. <br />• Topsoil stockpiles observed were marked with identifying signs. <br />ROADS Rule — 4. 03 <br />Number of Partial Inspection this Fiscal Year: 7 <br />Number of Complete Inspections this Fiscal Year: 4 <br />Page 2 of 9 <br />
