The Eaton Draw: 100 c.f.s. (CONDITIONAL). <br />7.3.4.5. The Galeton Draw: 20 c.f.s (CONDITIONAL). <br />7.3.4.6. Owl Creek: 14 c.f.s. (CONDITIONAL). <br />7.3.5. Cumulative Diversion Limitations: Applicant will limit its cumulative diversions <br />from any and/or all of the above described points of diversion so as not to exceed <br />650 c.f.s. in total and so as not to exceed the following flow limitations when used <br />for these purposes: <br />7.3.5.1. Diversion to Direct Irrigation: 150 c.f.s. <br />7.3.5.2. Diversion to Storage: 150 c.f.s. <br />7.3.6. Volumetric Limitation: Applicant shall limit its diversions under the water rights <br />claimed herein when diverted to recharge purposes to no more than 38,411 acre feet <br />annually and no more than 216,900 acre feet in any consecutive 20 year period. <br />During the first 20 years after the entry of this decree, Applicant shall limit its <br />diversions to no more than 108,450 for any consecutive 10 year period. <br />7.4. Uses. &TIJIMeficial uses claimed by Applicant for the water rights described above in <br />117.1, 7.2 and 7.1, are irrigation (agricultural and lawn irrigation), commercial, industrial, <br />IYMMUMMIF7ecreation, piscatorial, preservation and enhancement of wildlife habitat, <br />replacement of reservoir.vaporation, recharge, augmentation, exchangel,acement, <br />,ndieguriver- - - ,.as- Pply• <br />Saidbene icia uses m y e pace directly, o owing storage or by exchange, including <br />both internal system exchanges and river exchanges. The lands that may be irrigated are <br />located within Applicant's service area. In addition to using the water to irrigate the <br />lands of Applicant's shareholders, Applicant will also use the water for fish propagation <br />and surface recreation within the reservoirs; in exchanges to be later decreed or duly <br />approved, whereby the water will be exchanged for other water diverted at Applicant's <br />Cache La Poudre River headgate for the Greeley No. 2 Canal, or at other locations. The <br />water may also be used for augmentation and recharge purposes to augment the out -of - <br />priority depletions of the ground water alluvium of the Cache La Poudre River and/or <br />South Platte River, either by direct release, after storage or via recharge, including in <br />particular in the plan for augmentation that is the subject of the application before this <br />court in Case No. 04CW025, District Court, Water Division No. 1 (the water may also <br />be traded, sold or otherwise exchanged for other sources of fully consumable <br />augmentation water that may be used as a source of augmentation water in Case No. <br />04CW25), as well in other plans to be later decreed for the purpose of augmenting out - <br />of -priority depletions from wells located within Applicant's service area.
