would permit additional quantities of water from any source, other than what nature originally intended <br />to flow from his property onto any adjoining property or public right of way. <br />Section is Use of Premises: A person shall not use any of the premises in any land use area, which is <br />designed, arranged or intended to be occupied for any purpose other than expressly permitted in the <br />Declaration or in compliance with the Logan County Zoning Resolution, whichever is more restrictive. <br />All land shall be used only for residential purposes. Only two detached buildings not to exceed 1200 <br />square feet cumulative and 18 feet in height per building are allowed. No commercial use is allowed, <br />including but not limited to: mini -storage buildings, mining, confined animal feeding areas, and / or <br />commercial kennels... <br />It would appear to me that Mr. Schure is in violation of the very covenants he wrote by expanding his <br />commercial mine onto the lots he owned within the subdivision. <br />Under no circumstances do I see any reason that Mr. Schure should be allowed this permit for mine <br />expansion. I have always tried to keep an open mind in my past dealings with Mr. Schure. This planned <br />expansion of his mine goes too far. In my opinion, he clearly has no regard for the neighboring home <br />and land owners that he sold property to in the past. I have been trying to sell my property for years as <br />now live in Wyoming. Any chance of selling this lot would be eliminated with a commercial gravel pit in <br />the back yard. In my mind Mr. Schure's motivations are purely selfish and serve no benefit to the <br />subdivision or any of its owners. <br />I again request that this application for mine expansion be denied. I would also suggest since there has <br />already been mining activity in the past year without any notification to the adjacent land owners that <br />this activity was without proper permits and should be investigated further by your board. My last visit <br />to my property I viewed numerous tire tracks crossing my property and continuing up to the new mining <br />area. The damage to my property has already started due to Mr. Schure's operations. I view this as <br />trespassing and will not tolerate it in the future. <br />I hope these comments are helpful in your decisions regarding this application. <br />I do hope to hear from the board soon regarding the status of this application and the final outcome of <br />this process. <br />Thank you for your time. <br />Sincerely, <br />Thomas J.
