On the plat map filed with Logan County my property is Lot 3 of the Sand Creek Estates. <br />This subdivision has 12 lots per the plat map that was filed August 29, 2002 with Logan County. There <br />are three lots (#6, 7, and 8) that are north of my property, which Mr. Schure owns, between the original <br />gravel pit and my lot. <br />I bought this property from Mr. Schure with final payment occurring in June of 2004. Several other <br />individuals have also purchased lots in this subdivision with the understanding that there was no more <br />activity at the mine and that there was a reasonable amount of land between the mine and our <br />properties. I clearly would have not purchased this piece of property if it was known to me that Mr. <br />Schure had further plans to use his original mining pit commercially or to expand the pit into our <br />subdivision. The mining activity that close to residential dwellings should not be allowed at all. The <br />existence of such an operation with children and small pets living nearby puts them all in jeopardy. <br />All the lots fall under the same covenant protections that exist for the entire subdivision. <br />The map of the proposed mine expansion clearly cuts into the empty lots north of my property and well <br />into our subdivision. There already has been digging at this site in the past year without any knowledge <br />of the members of the subdivision. The Sand Creek Estates Nome Owners Association covenants <br />protecting the subdivision were written by Mr. Schure himself. As Mr. Schure writes in the covenants <br />section 4 titled Land Use areas - General: <br />Section h: Unnatural Drainage: Under no circumstances shall an owner of any lot of parcel of land be <br />permitted to deliberately alter the topographic conditions of his lot or parcel of land in any way that <br />
