May 5, 2015 C-2010-089/New Horizon North Mine BFB <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The portable pump at Pond NH1 which pumps water to the facilities area for dust control, was in a rubber <br />lined pan to control leaks and spills (photo 1). The pump was also surrounded by panels and had a fire <br />extinguisher on site. <br />The Pond 001 discharge flume was re -set and is now level (photos 2 & 3). The cattails were also removed. There <br />was a small amount of water passing through the flume but the source of the water was unknown as Pond 001 only <br />contained a little water and was not discharging. The water may have been coming from the surrounding soils <br />which appeared to be saturated from the recent rain. The long rod that controls the east valve of the Pond 001 <br />spillway has fallen off (photo 4). The emergency spillway was free and clear of obstructions. <br />Culvert C-11 is shown on Map 2.05.3(4)-1 - Surface Water Hydrology being in the Haul Road North Ditch. In the <br />field, this culvert was not installed and the area appears to be a low water crossing. A low water crossing is shown <br />on the same map just south of culvert C-11 and it too was not installed. In the field, the water from the south side <br />of the haul road is directed to the Haul Road South Ditch. The Haul Road South Ditch flows south toward the <br />Pond 001 East Ditch but is not well defined in the area west of the topsoil stockpiles where the water crosses the <br />main road into the Haul Road North Ditch. The map and/or field conditions need to be amended so they are <br />consistent. <br />The road between Pond 001 and the spoil pile has a ditch along its south side. The ditch flows to the east end of <br />Pond 001 and connects with the east ditch. This road ditch is not on Map 2.05.3(4)-1 Surface Water Hydrology <br />and needs to be added. After further review and a discussion with Mr. Tony Tennyson (Tri-State Generation and <br />Transmission), this road and its associated ditch do not need to be added to the map. It has been determined that <br />the road is not a haul road as it is not used to haul coal or spoil, the road and ditch are completely within the <br />sediment control structures of the mine and the road is within the disturbance boundary of the mine. <br />Culvert C-1 was free and clear of obstructions. Mr. Ferris cleared the tumbleweeds on the outlet side of the <br />culvert. Pond 001 East and West Ditches were free and clear of obstruction and in good condition (photo 5 & 6). <br />Pond 002 did not contain water and was not discharging. No work was being done on the pond. The interior and <br />exterior banks of the pond had been seeded. The north ditch was in good condition. <br />REVEGETATION — Rule 4.15 <br />Vegetative Cover; Timing: <br />The area around the Pond 001 flume had been reseeded. The embankment of Pond 001 is dominated by <br />Redstem filaree (storkbill), a Colorado list C noxious weed and needs to be treated. The embankment was seeded <br />after construction but very few planted species are present on the embankment, so spraying the storkbill and <br />reseeding will probably not yield better results. The Division will work with WFC to create a different plan to <br />control the storkbill and vegetate the Pond 001 embankment. <br />The north topsoil stockpile by the facilities area is lacking vegetation. The stockpile has been seeded and there is a <br />little evidence that the seeds are geminating.
