Mr. Lewicki <br />Page 4 <br />May 21, 2015 <br />17. The Applicant is proposing to import inert fill to the site. As required by Rule 3.1.5(9), please <br />provide the following information*: <br />a) Specify if the fill material will be stockpiled or immediately backfilled. If it will be <br />stockpiled, then specify the stockpile location and specify to the total volume of material <br />to be stockpiled at any given time. <br />b) Provide a general engineering plan stating how the material will be placed and stabilized <br />to avoid unacceptable settling and voids. <br />*The Applicant should note that the Permittee will be responsible for ensuring that all <br />imported material meets the Division's definition of `inert'. <br />18. The Mining Plan states that topsoil will either be directly respread on previously mined areas <br />and regraded or stockpiled for use in reclamation. The Division will assume that direct <br />replacement of topsoil will occur only when the maximum allowed disturbance has been <br />reached. The Division will bond for the worst case scenario which will assume all topsoil has <br />been stockpiled and the maximum allowed disturbance has been reached. Please respond. <br />19. The Mining Plan specifies the depth of the settling pond will be between 20-30 feet. The <br />settling pond is located approximately 80 feet from the edge of the Middle Fork of the South <br />Platte River. Exhibit G states that groundwater is generally found at the river level. It appears <br />the elevation of the bottom of the settling pond is below the elevation of the river. Please <br />explain how water will not be exposed in this excavation. <br />20. The Mining Plan states that Mr. Todd Sullivan has a water right for 2.0 CFS from the <br />Sacramento Ditch. Please provide documentation from the Office of the State Engineer <br />demonstrating that water from the Sacramento Ditch can be legally diverted and used in <br />conjunction with the proposed mining operation. <br />21. The comments the Division received from the Colorado Division of Water Resources refer to <br />the Platte City Placer Ditch (WDID 2300764). Please verify that the Westerman Ditch and <br />the Platte City Placer Ditch are one and the same. <br />22. The Mining Plan specifies there is an existing river crossing allowance from the Army Corps <br />of Engineers (ACOE). Please provide documentation demonstrating that the ACOE has <br />granted approval for the existing river crossing. <br />23. The Mining Plan specifies that a new river crossing will be constructed. Please indicate if the <br />Applicant has received approval from the ACOE for the new river crossing. In addition, <br />describe how the crossing will be constructed and provide a detail drawing of the crossing. <br />The Applicant shall also provide a brief plan detailing how material will be transported <br />across the river so that there is no loss of material into the river. <br />
