Mr. Lewicki <br />Page 2 <br />May 21, 2015 <br />3. The Division received comments from the Colorado Historical Society, Army Corps of <br />Engineers and the Colorado Division of Water Resources. The letters have been attached for <br />your review. Please address the comments noted in the letters, and make any changes in the <br />application as necessary. <br />6.4.1 Exhibit A — Legal Description <br />4. Exhibit A states that JRS Mining LLC owns 50% interest in the 40 acre Rock N Pine <br />property. Please confirm that no portion of the proposed permit area is located on the 40 acre <br />Rock N Pine property. <br />6.4.2 Exhibit B — Index Map <br />No comment. <br />6.4.3 Exhibit C — Pre -Mining and Mining Plan Map(s) of Affected Lands <br />5. The Applicant has stated the contours on Exhibit C-1 are an approximation of original pre - <br />mining contours. Pursuant to Rule 6.4.3, the pre -mining plan map is to depict the existing <br />topography of the area. Therefore, the contour lines should reflect the existing disturbance <br />created by pre -law mining. Please revise the pre -mining plan map accordingly. <br />6. Please outline and label any pre -law disturbance which will not be affected by the proposed <br />mining operation. <br />7. Please see additional comments under Items No. 9, 10, 11 and 38 regarding the Mining Plan <br />Map. <br />7.4.4 Exhibit D — Mining Plan <br />8. The Applicant has indicated the total disturbance will be limited to 1.6 acres in size. The total <br />disturbance must account for the existing and proposed disturbance. Please clarify if this <br />includes existing disturbance associated with the JRS Mining LLC operation (M-2013-074), <br />which will be incorporated into the permit area for this proposed operation. <br />9. The Mining Plan states the Westerman Ditch will be relocated once the Ditch Company has <br />approved the proposed activity. Please note that the relocation of the Westerman Ditch will <br />not be authorized by the Division until such time as approval from the Ditch Company has <br />been submitted. If the Applicant anticipates providing such written approval during the <br />review period for this application, then the Mining Plan and Mining Plan Map do not need to <br />be revised. If approval from the Ditch Company will not be obtained during the review <br />period, then the Mining Plan and Mining Plan Map will need to be revised eliminate the <br />
