Please note that most of the maps contained in the Technical Revision 105 submittal are also <br />contained in the Permit Revision 04 submittal. Since a number of the maps in this submittal <br />will be changing, their corresponding maps in the PR -04 submittal will also need to be <br />changed. To avoid any extra printing and shipping costs, the Division suggests that Colowyo <br />not change any of the maps in the PR -04 submittal until TR -105 has been approved. <br />Rule 3.02.2 — Determination of Performance Bond <br />13. To avoid unnecessary time an effort, the Division will determine the change in reclamation <br />liability for Technical Revision 105 following the completion of the technical adequacy <br />review(s). Please note that the Division is currently performing a midterm review of the <br />Colowyo permit. Since this revision proposes major changes to the reclamation liability, the <br />Division will not be calculating the reclamation liability at the Colowyo Mine in conjunction <br />with the midterm review. Rather, the Division will calculate a complete update of the <br />Colowyo Mine reclamation liability with Technical Revision 105, including the proposed <br />changes to the post -mining topography and drainage channels. <br />Rules 4.13 and 4.14 — Contemporaneous Reclamation and Backfilling and Grading <br />14. Mining in the West Pit has, for all practical purposes, been completed in the West Pit. Map <br />29 — Spoil Grading -South Area, shows a fairly good progression of backfilling and rough <br />grading until 2019. There is a reclamation block that is proposed for backfilling and rough <br />grading from 2020-2024. Additionally, there is a larger reclamation block that is proposed <br />for backfilling and rough grading from 2025-2029. Please explain why this additional time <br />is necessary for backfilling and rough grading these blocks. Please explain how this <br />timing meets the definition of contemporaneous reclamation as required by Rule 4.13. <br />Please include this discussion, as appropriate, in the permit under Rules 4.13 and 4.14. <br />15. There is a large reclamation block shown on Map 23 — Spoil Grading -South Area, with the <br />proposed backfilling and rough grading dates of 2025-2029. Given the size of this <br />reclamation block it would be appropriate to break it down into smaller reclamation blocks <br />with more definitive dates or date ranges. Please provide more detail for the backfilling <br />and rough grading of the large reclamation block shown on Map 23 with the dates from <br />2025-2029. <br />16. In the cover letter for Technical Revision 105 Tri-State states that they have consulted <br />landowners with regards to the proposed post -mining topography and received verbal <br />approval for the changes. Please provide the Division with written verification of <br />
