The Division will calculate the required financial warranty once all of the adequacy issues <br />have been addressed. <br />6.4.13 Exhibit M — Other Permits and Licenses <br />33. Exhibit M references that an approval is being sought from the Water Supply and Storage <br />Company. Please explain what approval or permit is needed from the Water Supply and <br />Storage Company. <br />34. The Stormwater Discharge Permit which was enclosed with the permit application expired on <br />September 30, 2012. Please provide a copy of a valid Stormwater Discharge Permit. <br />6.4.14 Exhibit N — Source of Legal Right to Enter <br />35. The lease agreement provided in the permit application is between Mr. William H. Porter <br />(landowner) and US, LLC (tenant). The source of legal right to enter the property must be <br />made between the landowner and the Permittee (Stone Wholesale, Inc.). Please provide a <br />lease agreement that was made between the landowner and Stone Wholesale, Inc. or <br />otherwise demonstrate US, LLC and Stone Wholesale, Inc. are owned and operated by the <br />same entity. Also, the Operator should note that US, LLC is not currently registered with the <br />Colorado Secretary of State (SOS). In order to do business in the state of Colorado, including <br />entering into lease agreements, the company must be registered with the SOS. <br />36. During the inspection conducted on April 23, 2015, the Operator informed the Division that <br />the landowner of the 4.4 acre parcel, Mr. William H. Porter, is recently deceased. The <br />Operator must demonstrate to the Division that the lease agreement is still valid. <br />37. The copy of the lease agreement submitted with the permit application references a legal <br />description of the property in Exhibit A, which was not attached to the document. Please <br />provide any addendums to the lease agreement which provide a legal description of the <br />property which is being leased. <br />6.4.15 Exhibit O — Owner(s) of Record of Affected Land (Surface Area) and Owners of <br />Substance to be Mined <br />No comment. <br />6.4.16 Exhibit P — Municipalities Within Two Miles <br />No comment. <br />
