Mr. Striggow <br />Page 2 <br />May 13, 2015 <br />6.4.1 Exhibit A — Legal Description <br />4. The legal description delineates a 12.6 acre parcel of land. However, the amended area is <br />only 4.4 acres in size. Please provide a legal description that is specific to the 4.4 acre parcel <br />which is being added to the current affected area. The Operator may revise the metes and <br />bounds description or may specify the township, range, and section, to at least the nearest <br />quarter -quarter section. <br />6.4.2 Exhibit B — Index Map <br />No comment. <br />6.4.3 Exhibit C — Pre -mining and Mining Plan Map(s) of Affected Lands <br />5. The Operator has submitted multiple maps to portray the required information for Exhibit C. <br />Two of the three maps which were submitted do not conform to the general map <br />requirements outlined in Rule 6.2.1(2). All maps must identify and outline the area which <br />corresponds to the application and must be prepared at a scale not larger than 1 inch = 50 feet <br />nor smaller than 1 inch = 660 feet. Please revise the two maps to meet the above listed <br />criteria or submit a single map which contains all of the required information. <br />6. The maps do not depict the 3.03 acre parcel of land that was added to the permit area through <br />Amendment No. 1 in 2011. Please revise the map(s) to include the entire permitted area. <br />7. The maps which were submitted for Exhibit C did not include the existing topography of the <br />area with contour lines of sufficient detail to portray the direction and rate of slope of the <br />affected land. Please revise one or all of the maps to include the existing topography of the <br />site. <br />8. The Mining Plan Maps do not depict the proposed earthen berm. Please revise one or all of <br />the maps to include this structure. <br />9. As required by Rule 6.4.3(b), the Mining Plan Map must portray all power and <br />communication lines. Please revise the map(s) to include the above ground utilities which <br />currently are present on the amended area. <br />10. The maps which were submitted for Exhibit C did not depict all of the haul roads. In <br />addition, the overburden stockpiles located north of the Poudre Valley Canal were not <br />depicted on the maps. Please revise the map(s) to include all haul roads and all overburden <br />stockpiles. <br />11. Please revise the map(s) to include all stormwater retention basins. <br />
