This letter and <br />its attachments are intended to act as the packet response to your letter. In addition, our letter <br />incorporates comments from the inspection report dated 14 April 2015. We have formatted our letter <br />in a similar fashion as to the TAR letter so that our response can easily be matched with each specific <br />TAR comment. We will send a copy to the Division's Denver offices and place a copy with the La Plata <br />County Clerk and Recorder for public review. <br />For application consistency purposes, we had to correct several additional items not mentioned in the <br />TAR letter, so we have listed those items at the end of our direct responses below. <br />Application Form, Item 3, Page 1 <br />We have maintained the proposed permitted acreage of 220 acres. No replacement application form is <br />required. <br />Structure Agreement <br />As stated on page 5 of your TAR letter under Exhibit S — Permanent Manmade Structures, Rule 6.4.19 no <br />action is necessary for the BP well. <br />Exhibit C — Pre - mining and Mining Plan Maps (Rule 6.4.3) <br />A new Mining Plan map is provided as an attachment to this letter. The map has been updated to <br />reflect a map scale, signature, and all requirements listed in Rule 6.4.3. <br />Attached to this letter is a copy of all notices and certified mail return receipts sent to the Owners of <br />Record of surface land within 200 feet <br />11 Page <br />
