• Rebuilding the ditch access road on City of Greeley property (only in the flood
impacted area)
• Laying back the slope of the newly formed incised channel
• Maintaining existing grades of the new channel to approximately the current in-
field conditions
This scope of work and the project geometry have been developed based on several
constraints, including the project's location in the 100 -year floodplain. The associated
floodplain regulations as implemented through the project floodplain development permit
direct the project to maintain grading and water surface elevations to match closely with
the existing post -flood field conditions. As a result, the project maintains the newly -
formed incised channel. Additionally, the continued risk of erosion in this area
originating at the unprotected earthen embankment of the Al gravel pit makes it unwise
and cost prohibitive, considering BIC's limited financial resources, to continually fill in
flood - induced erosion areas. Finally, the project layout was developed to provide
maximum flexibility to Al in its efforts to repair and stabilize its gravel pit embankment.
It is BIC's expectation that that work by Al will be completed in a manner that will
provide appropriate flood protection measures.
BIC will construct some of the project improvements (including the upstream and
downstream tie -ins to the existing pipe, the buried rip rap, and the sheet pile wall) in its
existing prescriptive easement, which runs north/south along the western edge of the
Property. The remaining work (including the rebuilt siphon and access road) will be
located on the western, adjacent property. BIC, in limiting the amount of work done in its
existing easement does not waive, in any fashion, its ability to make full use of the
easement in the future. Further, by doing this work and mitigating its damages, BIC does
not waive any rights it has to hold 83rd and Al liable for damages resulting from actions
or omissions by either or both entities.
Please call or email me if you would like to discuss this project.
Best regards,
Roger Schmidt
Boyd Irrigation Company President
cc: Peter Hayes, Colorado DRMS
Eric Reckentine, BIC
Christie Coleman, BIC
Jeff Kahn, Lyons Gaddis Kahn Hall Jeffers Dworak & Grant, PC
