King Coal Mine (C- 1981 -035)
MT -07 Response
2.05.6 Mitigation of Impacts of Mining Operations
1. Rule(s) 2.05.6(2)(a) -(c), 4.04(1)(a), and 4.18- Based on the requirements of Rule 2.05.6(2)(a)-
(c), C- 1981 -035 is required to contain a fish and wildlife plan consistent with Rule 4.18.
Based on the information presented in Appendix 8 of C- 1981 -035, provided by both the
USFWS and the CPW, due to the small size of the overall disturbance area the potential
impacts to wildlife are minimal. However, Appendix 8 also includes a list of species that are
found in La Plata County and which may occur within the permit area; as such there is no
specific fish and wildlife plan in accordance with 2.05.6(2)(a) -(c) which specifically discusses
how the plan will minimize disturbances and adverse impacts on fish and wildlife and
related environmental values during mining and reclamation operations found or
potentially found within the permit and adjacent areas.
a. Please submit a fish and wildlife plan consistent with Rule 4.18 based on the
determination that there will be impacts to fish and wildlife.
b. If an update to the information to include new or added T &E species, and discussion
of potential impacts to current State and Federal Threatened and Endangered plant
and animal species lists, shows that the plan will require compliance with Rule
2.05.6(2)(a)(iii)(A) and (B), please include the information with the plan.
As mentioned earlier, a request has been submitted to the US Fish & Wildlife Service and
the CSU Natural Resources Database for updated information. Once this information
is received, this section will be updated.
2. A determination of the probable hydrologic consequences is presented in Section 2.05.6 of
the approved permit application package. GCC has predicted that there will not be any
negative impacts to the hydrologic balance. Under 2.04.7, above, the Division has
requested that the baseline hydrology sections of the permit be updated. Please update
the discussion of probable hydrologic consequences to incorporate any new information
that is obtained, in accordance with 2.05.6(3)(b)(iii).
As mentioned earlier, a search of Colorado Division of Water Resources records has been
performed and all water resource information within a 1 mile radius of the permit area is
now included as a table in King I and King II Sections 2.04.7. Copies of CDWR well data for
each well is included to replace the existing well data at the end of King II Appendix 4(2).
A statement has been added to King I Section 2.04.7 page 6 directing the reader to see
King II Appendix 4(2) for copies of CDWR well data sheets.
2.10 Maps and Plans
1. 2.10.1 sets forth general requirements for maps. Map King 1 -001 does not identify the
Townships and Ranges. Map King II -001 is at a scale of 1" = 2.7 miles, and does not legibly
detail the information shown on the 1:24,000 USGS series; nor is the permit area boundary
Page 8
