King Coal Mine (C- 1981 -035) <br />MT -07 Response <br />1. The fish and wildlife study required under 2.04.11 consisted of a review of the wildlife <br />species lists on the Natural Diversity Information Source of the DPW and the Colorado <br />Natural Areas Program database for the areas of the King I and II Mines. These queries were <br />conducted in 2005 and 2006 for the King II application. A new survey was conducted for <br />development drilling locations at King II in 2014. King II Appendix 8 includes a list of <br />potential species within the permit area. Please update the information to include new or <br />added T &E species and discuss potential impacts to current State and Federal Threatened <br />and Endangered plant and animal species lists. The Federal and State listed species of <br />concern may have changed since the last revision or the issuance of permit. <br />A request has been sent to the U.S. Fish & Wildlife Service for a concurrence letter concerning <br />threatened and endangered species. Also, GCC Energy has requested an update from the <br />Natural Resources Database at CSU. We have, as yet, received no response from either <br />source. These reports will be been forwarded upon receipt. <br />2.05.3 Operation Plan — Permit Area <br />1. Rule 2.05.3(2) Operation Description <br />a. Paragraph (b) requires that all proposed surface disturbances to be associated with the <br />underground mining activities be described and shown on a map. Map King II -005 <br />illustrates the proposed mine workings, but does not show the locations of drill holes. <br />Please update this map to identify and show locations for the nine development drill <br />holes approved under TR -22. <br />The nine development drill holes approved under TR -22 are now shown on Map King 11- <br />005. <br />b. The Division understands that other than development of the mains, mining <br />operations at King II have occurred thus far solely within the OSM permit area. In <br />accordance with 2.05.3(2)(b), please amend Map King II -005 to show the proposed <br />timetable for mining the coal resource located within the DRMS permit. <br />Map King II -005 has been amended to show an approximate timetable for mining the coal <br />resource located within the DRMS permit area. <br />2. Rule 2.05.3(4) Ponds, Impoundments, other treatment facilities and diversions. <br />GCC is in the process of preparing a Technical Revision (TR) application to update surface <br />water portions of the King II permit to reflect as -built conditions (this topic is discussed <br />further in the Division's inspection report for Jan. 28, 2015). <br />The as -built surface water portions of the King II permit are being reviewed and revised <br />as necessary to reflect current conditions. A Technical Revision application is <br />forthcoming. A 2 foot precision aerial survey of the King I and King II sites has been <br />Page 6 <br />
