j. Lessee agrees to follow the Mining Plan, and Lessee will obtain Lessor's <br />prior approval of any variations from the Mining Plan. All approved and <br />completed alterations, improvements or modifications shall become part <br />of the Premises and title shall vest in Lessor; provided that Lessor, at its <br />discretion, may require that such alterations and improvements be <br />removed by Lessee at the end of the Term, at Lessee's cost and expense. <br />k. Lessee shall pay all costs and expenses for utilities, electricity, and fuel for <br />Lessee's operations on the Premises. <br />14. Liens; Claims. If, because of any act or omission of Lessee, its agents, employees, <br />licensees, invitees, any claim is made against Lessor's Property or Lessee's reclamation <br />bond or if any mechanic's lien or other lien, charge or order for the payment of money <br />shall be filed against Lessor or any portion of the Leased Premises, Lessee shall, at its <br />own cost and expense, cause the same to be discharged of record or bonded within thirty <br />(30) days after the filing thereof. <br />15. Termination At Expiration. At least 90 days prior to the end of the Term, Lessee shall <br />give notice to Lessor of Lessee's intent to quit the Leased Premises at the end of such <br />Term, and Lessee shall have no further Minimum Royalty obligations beyond the end of <br />the Term if its prior Minimum Royalty obligations during the Term have been fully met <br />pursuant to the terms of this Lease. Within 90 days after the end of the Term, Lessee <br />shall remove from the Leased Premises all equipment, vehicles, stockpiled materials <br />owned by Lessee, and other improvements or personal property and shall complete <br />reclamation of the Leased Premises to the condition required by the Permits and this <br />Lease. The insurance required in this Lease shall remain in effect during the performance <br />of the obligations described in this section. Lessee shall execute any application to cause <br />the Permits to be transferred back to Lessor. If Lessee fails to timely complete the <br />reclamation, Lessor shall have the right to claim on the Lessee's reclamation bond, in <br />addition to seeking damages for failure to comply. <br />16. Insurance. Lessee agrees to keep in full force and effect, and pay the premiums thereon, a <br />policy or policies of public liability and property damage insurance covering all of <br />Lessee's operations on the Leased Premises with liability limits of at least $2,000,000.00 <br />per person and per occurrence with respect to bodily injury or death and not less than <br />$2,000,000 in respect to any damage to or destruction of property; and not less than <br />$2,000,000 environmental liability policy. Lessee also agrees to procure, maintain in <br />effect, and pay the premium on a policy or policies of Workmen's Compensation <br />Insurance insuring Lessee's employees in the amounts required by law. Lessee shall <br />supply current certificates evidencing such insurance to Lessor, and shall include Lessor <br />as an additional named insured under the commercial general liability coverage. <br />17. Lessor's Covenants and Warranties. <br />a. Lessor covenants and warrants and agrees to defend Lessee in the quiet <br />enjoyment and possession of the Leased Premises during the Term of this <br />
