plants, asphalt or similar plants, and storage of related equipment, within <br />the limits of the Permits. <br />b. A non - exclusive right of access to and from and ingress and/or egress on, <br />over and across Lessor's Property and to and from the public road via a <br />CDOT access and roadway crossing neighboring property(s) to Lessor's <br />Property. Lessor shall have the right to alter such accesses and the <br />locations of ingress and/or egress points during the term of the <br />Lease. Lessor shall incur any and all costs of alterations performed by it <br />or its contractors to the access roads. Any alterations to accesses shall not <br />impede or alter Crossfire Aggregate Services LLC. operations. <br />C. The lease estate, the right -of -way and other appurtenant rights described in <br />Paragraphs a & b above are collectively referred to herein as part of the <br />Leased Premises. <br />d. Exhibit A, is a map that depicts the outer boundary of the Leased Premises <br />and the areas within such that will be mined in succession ( "Mining <br />Plan"). Said Mining Plan shall identify "lots" to be mined in succession. <br />Upon execution of this Lease, and Exhibit A hereto and incorporated by <br />reference, the Lessor and Lessee will have accepted said Mining Plan in <br />substance and content and Lessor will have no right to further direct the <br />Lessee's operations, whatsoever, except consistent with the terms of this <br />Lease. <br />3. Term and Option to Extend. Unless sooner terminated as herein provided, the term of <br />this Lease shall be for three (3) years, commencing as of the Effective Date (the "Initial <br />Term "). At the expiration of the Initial Term, this Lease shall automatically expire unless <br />the term is extended pursuant to the terms hereof. Provided Lessee is not in default <br />hereunder, and provided Lessor and Lessee reach agreement as to a Production Royalty <br />rate for extension of the term, Lessee may extend the term of this Lease for five (5) <br />additional years beyond the Initial Term, on the same terms and conditions as during the <br />Initial Term, subject to the amended mutually acceptable Production Royalty rate, by <br />giving Lessor written notice of its intent to extend at least ninety (90) days prior to the <br />end of the Initial Term. Nothing contained in the Lease shall preclude or prohibit the <br />parties from negotiating a further or additional lease for the Leased Premises. The Initial <br />Term and any extensions obtained pursuant to this Section are referred to collectively as <br />the "Term" of this Lease. <br />4. Termination. <br />a. Lessor shall have the right at Lessor's option to terminate this Lease if <br />Lessee fails to perform any of its obligations hereunder as follows: <br />i. If Lessee fails to pay when due any amounts to be paid hereunder, <br />Lessor may at Lessor's option give Lessee written notice of such <br />
