1. Groundwater Exposure <br />At the time of Division inspections in 2008' and 2014" there was water exposed in the northeast corner <br />of the pit. The water appears to have been present from 2008 through 2014. The elevation of the water <br />in the pit closely corresponds to that of the well on the adjacent John Kovacs property which has a <br />"depth to water" of one foot and a total depth of twelve feet "'. Satellite data from various months and <br />years shows that the water is present in the pond whether or not the pit is fully operating ". Please <br />confirm that the Kattenberg pit has been and is in compliance with Section 37 -90- 137(11) C.R.S., Section <br />34- 32.5- 116(4)(h) C.R.S, Rule 3.1.6(1)(a),Rule 6.3.3 (j) and Rule6.4.5(2)(c) and the Office of State <br />Engineers Office March 17, 2004 Conditions for Approval.
