As proposed, the Operator requests to have the site's reclamation cost estimate only to be calculated for Tract <br />1, the original 110c permit boundary. Please note that the Division observed approximately 5.89 acres had <br />been disturbed outside of this boundary during the October 6, 2014 inspection. All current disturbances will <br />need to be bonded for. Please propose to be approved for all the tracts currently affected, or revise the current <br />shape /size of Tract 1 to encompass (at a minimum) the current disturbance; if the later is chosen, the Mining <br />Plan, Mine Plan Map, and Reclamation costs will need to updated and resubmitted. <br />22. Please provide the Division with the approximate size (in acres) of the currently disturbed area within Tract 6 <br />which is the area in reclamation of the adjacent CDOT mining permit M- 1979 -160. As explained above this <br />area is not fully releasable yet and will need to be accounted for in the reclamation cost estimate for this <br />conversion application; this acreage will be used for a general grading task to mitigate any future erosion and <br />a re- vegetation task to establish adequate vegetation. <br />EXHIBIT M — Other Permits and Licenses (Rule 6.4.13): <br />23. In the conversion application, the Operator states that a NPDES permit to cover storm water runoff and <br />dewatering is not required. Please supply further information and data to justify that "all storm water will soak <br />into the ground before it can leave the site." In lieu of this data, commit to obtaining a Stormwater Discharge <br />Permit. The Operator shall contact the Water Quality Control Division (WQCD) of the Colorado Department <br />of Public Health and Environment for further information regarding this permit .Please supply the Division <br />with a copy of the submitted permit application or WQCD correspondence demonstrating that the proposed <br />plan will not require a permit. <br />EXHIBIT R — Proof of Filing with County Clerk and Recorder (Rule 6.4.18): <br />24. Please note that any changes or additions to the application on file in our office must also be reflected in the <br />public review copy, which was placed with the Logan County Clerk and Recorder by the Operator. Please <br />submit proof that the public review copy has been updated or a copy of the response to this adequacy letter <br />has been added to it. <br />EXHIBIT S - Permanent Man -Made Structures (Rule 6.4.19): <br />25. Please submit the notarized agreements between the Operator and the persons having interests in the structures <br />provided in the Incompleteness Response letter received March 23, 2015, or submit other documentation in <br />accordance with Rule 6.4.19. <br />This concludes the Division's adequacy review of this application. This letter shall not be interpreted to mean that <br />there are no other technical deficiencies in your application. Other issues may arise as additional information is <br />supplied. Please be advised the Conversion Application for the Dollerschell Pit - permit may be deemed <br />inadequate, and the application may be denied on June 3, 2015, unless the above mentioned adequacy <br />review items are addressed to the satisfaction of the Division. If more time is'needed to complete the reply, the <br />Mined Land Reclamation Board may grant an extension to the Board Ordered decision date. This request for <br />additional time would need to be directed to the MLRB, received no later than the deadline date (the MLRB will <br />have a meeting on May 27, 2015). <br />To make the process more efficient, the Division has attached the new Performance warranty form which will <br />need to be filled out, notarized, and returned prior to permit issuance. <br />
