• From: Ric Fanyo [rfanyoCa)-dufford brown. com]
• Sent: Wednesday, April 22, 2015 5:46 PM
• To: Jeff Fugate
• Cc: John Adams; George Patterson (efcoal(a)gmail.com)
• Subject: RE: TR -43 and MW- NW - -EFCI
> Thank you, Jeff,
> Per our discussion today and on behalf of EFCI, I hereby request extensions of the abatement
deadline for NOV CR- 2013 -0002 to July 31, 2015, and of the decision deadline for TR -43 to
August 28, 2015. 1 understand from our discussion today that these extensions are agreeable to
the DRMS.
> EFCI has been interviewing drillers about re- drilling MW -NW or a new hole nearby and should
have proposals in the near future.
> As I emphasized today, we need a second adequacy letter from the DRMS with a definitive
statement of the additional information DRMS needs to make a decision on TR -43. We
understand from our call last week that the only information needed is the results of the new
drilling, and if the hole is not dry, then data regarding the quantity and quality of the water
encountered in the abandoned mine workings. If the new drilling intercepts groundwater in the
abandoned mine workings, EFCI will provide that data.
> I understand that the DRMS will provide the second adequacy letter in the next few days.
After we receive that, EFCI will submit its drilling plan for advance approval, and if necessary,
schedule a meeting with the DRMS to discuss it.
> Regards,
> Ric
