4.1- Lessee may remove and dispose of all brush, trees, undergrowth, and other <br />vegetation from such portions of the leased premises as may be reasonably necessary to explore <br />for materials or to locate roads, pits, quarries, stockpile areas, and/or buildings and equipment. <br />All of such vegetation, together with vegetation which Lessee may remove from the Leased <br />Premises, shall be deposited and disposed of only at such locations on Lessor's property and in <br />such manner as may be approved by Lessor. The exact disposal site location shall be determined <br />at the sole option of Lessor. Lessee agrees, at its expense, to dig a hole at the disposal site into <br />which all combustible materials will be dumped. Such materials will be burned and, as part of <br />Lessee's reclamation obligations pursuant to this Lease, Lessee shall fill the hole at the disposal <br />site and leave the site graded and in a condition acceptable to Lessor. <br />4.2 -All topsoil removed from the pit area prior to the removal of gravel materials shall <br />be stockpiled next to the pit. The exact location of all such topsoil shall be determined with the <br />consent of Lessor. <br />43 - Lessee is hereby granted the right to construct, operate, maintain, replace, and <br />relocate facilities on the leased premises necessary or reasonably convenient for the operation of <br />its businesses contemplated herein including but not limited to concrete /asphalt batch plants <br />and/or other permanent structures which may be located upon the leased premises without the <br />written consent of the Lessor as long as the Lessee provides Lessor twenty days written notice in <br />advance of the construction of any such plants and/or permanent structures on the property. <br />5. PAYMENT OF TAXES <br />. 5.1- Lessor agrees to pay all ad valorem, real estate taxes levied against the leased <br />premises before the same become delinquent. In the event that Lessor fails to pay such taxes, <br />Lessee may, at its option, pay any such taxes and assessments as may be levied against the <br />premises and deduct the amount of such payments, together with any penalties or interest <br />required to be paid, from the amount thereafter due to Lessor hereunder. <br />6. REMOVAL OF IMPROVEMENTS AND EQUIPMENT <br />6.1- All improvements and equipment placed on the leased premises by Lessee, except <br />fences, gates, and cattle guards, shall remain the property of Lessee, and Lessee shall have the <br />right to remove such property prior to the expiration of this Lease so long as no monetary <br />defaults exist. On termination of this Lease for any cause other than nonpayment of royalties, <br />Lessee shall remove all such improvements and equipment within sixty (60) days from the date <br />of termination except fences, gates and cattle guards, unless an agreement is entered into with <br />Lessor concerning leaving improvements in place. If the Lease is terminated for non - payment of <br />royalties, upon payment to Lessor of any delinquent royalties,'Lessee shall then have the right to <br />remove all such improvements and equipment within sixty (60) days thereafter, except fences, <br />gates and cattle guards. <br />Page 4 of 10 <br />
