actually being used in mining activities of the Lessee and to accept the leased premises in its <br />present condition. <br />3.5 - To keep the leased premises at all times clear of trash, rubbish, or junk, unless <br />prevented by extraordinary conditions or temporary breakdown of equipment and to keep the <br />access to the leased premises locked at all times when operations are not being conducted.. <br />3.6 - To conduct a gravel operation and related activities and for no questionable or <br />improper purpose whatsoever. <br />3.7 - To provided the Lessor, during the term of this lease, 'certificates-of insurance <br />showing that the Lessee has in full force and effect public liability and property damage <br />insurance with an insurance company acceptable to Lessor with the following minimum <br />coverage: <br />Workmen's Compensation <br />Public Liability <br />Comprehensive, General and <br />Auto Liability <br />Blanket All Risk <br />Property Coverage <br />Statutory Amount <br />$1,000,000 <br />51,000,000 <br />51,000,000 <br />3.8 - At the termination of the Lease, to leave the leased property in an orderly and clean <br />condition conforming to the requirements of the reclamation plan shown in the Colorado <br />Division of Minerals and Geology "mining permit ", which will be attached hereto as Exhibit "C" <br />and incorporated herein when it is obtained. <br />3.9 - To pay all personal property taxes on the personal property of the Lessee in and <br />about the leased premises and also to be responsible for payment of all other taxes related to <br />Lessee's operation including but not limited to sales taxes. <br />3.10 - Not to cause or steer or allow any lien, judgment, levy or attachment to be placed <br />upon the property of the Lessor by reason of any actions of the Lessee of any nature or kind. <br />3.11- To utilize the leased premises as Lessee's only source of gravel for its operations <br />within a radius of thirty miles of Meeker, Colorado. <br />3.12 - To submit monthly reports showing the quantity of materials removed; to keep <br />strict and accurate records of materials removed; and to permit Lessor to examine mining <br />procedures and check books and records, all as provided in Paragraph 2 hereof. <br />4.
