Creek Mine assumed liability of the remaining 1,766.39 disturbed area acres (1,697.6 permanent <br />program lands and 68.79 pre -law lands) based on the approval of CDRMS Permit No. C- 2009 -087. The <br />Peabody Sage Creek Mine disturbed area acreage of 1,766.3 does not include the approved 52.60 <br />disturbed area acreage previously undisturbed by the Seneca II Mine. <br />Upon issuance of the Peabody Sage Creek Mine Permit, the Division at that time determined the <br />approved disturbed area was 2076.70 acres. This was composed of (1) the 1766.39 disturbed area acres <br />transferred from the Seneca II Permit; (2) 52.60 acres of newly proposed disturbed area; and (3) 257.71 <br />acres of disturbed lands that had been previously granted Phase III release while within the Seneca II <br />Mine Permit (Table 3, first column). During the Division's 2013 midterm review of the Peabody Sage <br />Creek Mine permit, it was determined that 178.15 acres of the 257.71 disturbed area acres that had been <br />previously been Phase III released should not have been re- permitted. This discrepancy was corrected <br />with Minor Revision No. 13. Subsequent to the issuance of the Peabody Sage Creek Mine Permit, an <br />additional 14.25 disturbed area acres were approved to be disturbed via various revisions.
