PERMIT #: M- 1977 -324 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: June 19, 2014 <br />OBSERVATIONS <br />This inspection was conducted as part of the regular monitoring program. Messrs. Joe and Matt Welte were <br />present for the inspection, representing the Operator (Summit Brick & Tile Co.). Mr. Phil Courtney was also <br />present, representing the State Land Board. This is a 112c clay mine. The mine was not operating at the time <br />of the inspection. The Stocks Clay Mine is accessed from Red Canyon Road (Co Road 9), approximately 4.5 <br />miles north of Canon City. <br />Inspection: <br />A permit sign was posted near the site entrance (see Photo 1). The permit area boundaries are marked with <br />T -posts (see Photos 2a & 2b). There are two active pits on site. The larger pit is to the west (see Photo 3), the <br />smaller pit near the center of the permit area (see Photo 4). The highwalls ranged from 10 to 20 feet high in <br />the west pit and 10 to 15 feet high in the smaller, central pit. Mining activity appeared to be relatively recent. <br />The highwalls appeared stable at the time of the inspection. The Operator representatives indicated blasting <br />operations are contracted out to LCI in Penrose and occur about once a year. <br />Equipment observed onsite included a truck, dozer, backhoe, and grizzly screen (see Photos 4, 5 and 6). <br />Reclamation activity — The southeast portion of the disturbed area has been backfilled, graded and seeded <br />(see Photos 7 and 8). The Operators indicated their goal is to get nearly 6 acres reclaimed to be released. <br />Using Google Earth Pro to measure the disturbed area, based on a 9/24/2013 satellite image, the Division <br />estimated the total disturbed area to be approximately 12.4 acres. The area being reclaimed in the southeast <br />corner of the site was estimated to be approximately 3.5 acres, using the same method. <br />Records: <br />• The total permitted area is 280 acres, with a phased maximum affected area of 18.1 acres. <br />• Revisions: <br />• Major revisions — conversion to a 112c permit in 1993. The conversion application <br />requested intermittent (IS) status as the Operator expected the mine to operate less than <br />six months per year. <br />• Minor revisions — A) a revision was approved by the Division on 8/14/1981 to increase the <br />extraction rates; B) Technical Revision 1 changed the highwall reclamation plan. The <br />Division's records are incomplete as to what changes were requested. <br />• The previous inspection was performed on 11/20/2009. No problems were cited. <br />• The anniversary date is February17. Annual reports and fees are current through 2015. The 2015 <br />annual report indicated 9.25 acres had been affected. <br />• The post -mine land use is rangeland. <br />Stipulations: from 12/14/93 letter: <br />As part of the approved conversion to a 112c permit in 1993, the Operator agreed to the following: Subject to <br />field delineation by the Division, that portion of the Joe Stock property disturbed by the unpermitted mining of <br />moss rock by American Stone and Landscaping and referred to in Notice of Violation M -93 -018 is excluded <br />from inclusion in the approved, expanded permit area of M -77 -324 until reclamation of the mining has been <br />completed. This exclusion will only extend to that area of the unpermitted moss rock mining that lies outside <br />Page 2 of 7 <br />
