5) In re your ¶5 the driveway has been eliminated from the Reclamation Plan Map. <br />The entire disturbed area will be reclaimed as stated in Exhibit D, the Reclamation Plan. <br />6.3.5 Exhibit E — Map <br />6) In re your ¶7, an amended Reclamation Plan Map "P -4a" has been prepared to <br />show the permit boundary. In addition the map has been redrawn to a scale of 1 " =50' to meet <br />the requirements of Rule 6.2.1(2)(e). <br />7) In re your ¶8 an amended Reclamation Plan Map "P -4a" has been prepared and <br />submitted herewith. <br />8) In re your ¶9 the storm water structures have been clarified, and an appropriate <br />legend has been included on the amended Reclamation Plan Map "P -4a ". <br />9) In re your ¶10 a review by Mr. Danio of all land owners within 200 feet of the <br />affected land permit boundary additional un- notified land owners were identified. These <br />additional land owners were notified as required, and copies of the notices are attached hereto. In <br />addition an extension of the review for the by the Division is requested until April 10, 2015, to <br />permit comment by these additionally named land owners. <br />6.3.6 Exhibit F — List of Other Permits and Licenses Required <br />10) In re your ¶11 Exhibit T, the Environmental Protection Plan has been amended to <br />delete the term "hazardous waste ", and to add the term "characteristic waste" to remove any <br />ambiguity as to the type of materials processed and waste produced by the Federal Mill. The <br />wastes generated by the mill and mine operations are non hazardous for the reasons outlined <br />below. In addition the Federal Mill is located at: 3060 W. 58th Ave., Denver, Colorado 80221; <br />which is at the northwest corner of the intersection of I -76 and Federal Boulevard, in <br />unincorporated Adams County. The mill operator contacted Joe Scheiffelin of the Hazardous <br />waste commission as to applicability of the hazardous waste statutes to the Federal Mill. The <br />Colorado Revised Statues regarding Hazardous Waste clearly state that mining wastes are not <br />Hazardous Wastes, C.R.S. 25- 15- 101(6)(b)(VII): <br />"(b) "Hazardous waste" does not include: <br />VII. Any waste or other material exempted or otherwise not regulated as a <br />hazardous waste under the federal act, except as provided in section 25- 15- 302(4)(b);" <br />C.R.S. 25- 15- 302(4)(b) states that: <br />" The rules promulgated by the commission pursuant to the provisions of this part <br />3 covering the regulation of mining and mineral processing wastes, including exploration, <br />mining, milling, and smelting and the refining of waste, shall be identical to and no more <br />inclusive that the regulations of the federal environmental protection agency promulgated <br />pursuant to the federal act."
