Page 2.05 -3 indicates that Twentymile Coal, LLC (TC) is pursuing leasing the Federal coal with a <br />Lease By Modification (LBM) for the inclusion of the Wolf Creek Seam in the Federal Coal <br />Lease COC- 54608. The Division cannot approve a mine plan that includes mining in the Wolf <br />Creek Seam within this area until the LBM has been approved. Should the LBM not be approved <br />by the time all other PR -10 adequacy issues have been resolved, TCC will have to request <br />continued extension of the decision due date until the LBM is approved. <br />Rule 2.04.5 — General Description of Hydrology and Geology <br />Revised page 2.04 -11, under the WOLF CREEK RESERVE section, indicates "initial <br />development and mining of Panels WC -9RT through 5RT would not be affected by pooled water <br />(See MSHA approval for development of Panel 9RT in Exhibit 53) ". Exhibit 53, submitted with <br />PR10, was reviewed. The MSHA letter dated December 31, 2014 in Exhibit 53 states that plans <br />and permits are required that give details about monitoring the currently flooded areas of the <br />Wadge seam prior to retreat mining in Panel 1 (which corresponds to WC -9RT) or any mining in <br />panels 6 -9 (which correspond to WC -4RT to 1RT) or panels 10 through 13 (which correspond to <br />panels WC -11RT to 14RT). Given this, it does not appear TC has obtained MSHA approval to <br />retreat mine in WC -9RT panel as proposed. Please either provide a plan for dewatering and <br />handling the pooled mine water in the Wadge Seam to accommodate longwall mining in the WC- <br />9RT panel or modify the mine plan so mining will not occur in this area. If the first option is <br />chosen, please provide documentation that MSHA has approved retreat mining in WC -9RT panel. <br />6. Exhibit 53 currently includes Confidential Wolf Creek Reserve, Geologic and Mine Plan <br />Information submitted with TR83. PR10 includes two documents, one an MSHA letter dated <br />December 31, 2014 with supplemental materials, the second is a letter from Peabody Energy <br />dated April 14, 2014 regarding an application for a coal lease by modification. Instruction on <br />where or how these documents will be included in the currently existing Exhibit 53 was not <br />included with the PR10 submittal. Also, it may be more appropriate to include the application for <br />a coal lease modification in Exhibit 2 of the permit instead of Exhibit 53. Please indicate how <br />these documents should be incorporated into the exhibits and paginated. <br />Rule 2.05.2; Operation Plan — Estimate Area for Life of Operations <br />7. PR10 included a revised Map 23; Wolf Creek PR14 -10, Mine Plan Modification. Currently, the <br />permit includes four maps: Map 23 — Mine Plan, Map 23a - 5 -Year Mine Plan with Subsidence <br />Monitoring Plan, Map 23b — Structures and Renewable Resources, and Map 23c- Mine Plan, <br />Surface Disturbance and Monitoring. Will the submitted map replace any of the currently <br />approved maps? If so, please indicate which map of the series it will replace and submit a revised <br />copy with the appropriate identification designation. <br />
