In fact, <br />it is believed that this property is owned by another private landowner outside of the subdivision <br />boundaries. We submit that any further transport of the excavated materials to the property <br />identified in your photograph #I would be in violation of the reclamation only permit. <br />Concerning your attached photo No. 2, showing the culvert for Equestrian Trail with the <br />appropriate compacted fill (road base), such culvert work was actually done by J13 Construction. <br />This work was contracted for by the Attkissons in May, 2011, with a total cost for that work of <br />$3,963.65 (see invoice attached). Therefore, credit with regard to the construction of the first <br />230 feet of Equestrian Trail from the intersection of Cross Creek Road and around the culvert <br />area should be credited to both JB Construction and Waldo Excavation thereafter. Of course, <br />those who have invested the time, equipment and expense to enhance both the culvert and the <br />roadway in this area would like to see it protected from any further degradation by Luke the <br />Duke's continued truck traffic. <br />As my clients wanted you to be fully informed as to the subdivision boundaries and the history <br />of improvements to Equestrian Trail, I am providing these corrections for your information and <br />the file. In the future, it might be helpful for you to consult my clients in addition to speaking <br />with the operator so as to get the full and complete picture.
