Compliance With Mine Plan N - Support Facilities Not On -site <br />N - Other N - Special Categories Of Mining <br />N - Processing Waste R - Topsoil <br />COMMENTS <br />This was a complete inspection of the Terror Creek Loadout conducted by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. Jim Kiger, representing Terror Creek, LLC, was on vacation. Kameal Clark <br />was in the office during the records check portion of the inspection. The Terror Creek Loadout is only operational <br />on an as- needed basis. Terror Creek brought in a skid - mounted crusher and screener from the Elk Creek Mine, as <br />the processing facility on -site does not work very well for the small amounts of coal needed for the local market. <br />The crusher is being operated by a contractor, Farnsworth. The site was not operating at the time of the <br />inspection. The weather was cool and overcast and the ground was basically dry. <br />On 28 February 2015 the Division issued a new permit for the Terror Creek Loadout. The permit was signed and <br />received at the Division on 16 March 2015. The new permit term runs through 23 August 2018. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />- All of the necessary records were available in Jim Kiger's office at the Elk Creek Mine. Please see the <br />Division's Availability of Records form at the end of this inspection report for more detailed information. <br />HYDROLOGIC BALANCE - Rule 4.05: Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, <br />4.05.9; Stream Buffer Zones 4.05.18: <br />- The sediment pond had a small pool of water in the bottom at the time of the inspection. The pond embankment <br />was well vegetated and stable and no erosional problems were noted. <br />- The dugout pond was dry at the time of the inspection. This is an incised pond. The pond inslopes and area <br />around the pond were well vegetated and stable. No erosional problems were noted on the pond inslopes or <br />surrounding area. <br />- The roadside ditches were all basically dry at the time of the inspection.
