Question #7 is updated (Page 2) and attached to show the Hradecky family as a surface owner. <br />They are also an adjoining landowner and are added to Exhibit O. <br />4. As mentioned in incompleteness item #3, Robert L and Deborah G Hradecky could have ownership <br />of lands within the affected area. If this is incorrect, they may own lands within 200 feet of the <br />affected area and will need to be listed as an adjoining property owner. <br />The expanded boundary of the Dollerschell pit does cross into property owned by the <br />Hradecky family but in which Mr. Schure has mineral rights. They will be added to the list <br />because they are actually a surface owner and an adjoining land owner. <br />5. Additionally, the Logan County Assessor records indicated a Bany Land LLC as the owner of the <br />property to the east of the permit. Please update the list of adjoining property owner to include this <br />owner. <br />Baney Land LLC is an adjoining property owner to the east and does lie within 200' of the <br />expanded boundary. There are hereby added to the adjoining property list. See revised Exhibit <br />O. <br />6.4.19 Exhibit S — Permanent Man -Made Structures <br />When mining operations will adversely affect the stability of any significant, valuable and permanent <br />man -made structure located within 200 feet of the affected area, the applicant may either: <br />(a) Provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any damage <br />to the structure; or <br />(b) Where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities <br />occurring at the mining operation; or <br />(c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, <br />will have "no negative effect" on their utility. <br />6. Review of the Aerial Map, submitted in Exhibit C, indicates there could be structures, associated <br />with residences along Shelbe Lane, within 200 feet of the permit boundary as well as one residence <br />along CR 29. Please provide an updated list of structures and structure owners for all structures <br />within 200 feet of the proposed permit boundary. An Exhibit C map will also need to be provided <br />or updated regarding Rule <br />6.4.3(g), the owner's name, type of structure, and location of these structures. <br />
