Question #7 is updated (Page 2) and attached to show the Hradecky family as a surface owner.
They are also an adjoining landowner and are added to Exhibit O.
4. As mentioned in incompleteness item #3, Robert L and Deborah G Hradecky could have ownership
of lands within the affected area. If this is incorrect, they may own lands within 200 feet of the
affected area and will need to be listed as an adjoining property owner.
The expanded boundary of the Dollerschell pit does cross into property owned by the
Hradecky family but in which Mr. Schure has mineral rights. They will be added to the list
because they are actually a surface owner and an adjoining land owner.
5. Additionally, the Logan County Assessor records indicated a Bany Land LLC as the owner of the
property to the east of the permit. Please update the list of adjoining property owner to include this
owner.
Baney Land LLC is an adjoining property owner to the east and does lie within 200' of the
expanded boundary. There are hereby added to the adjoining property list. See revised Exhibit
O.
6.4.19 Exhibit S — Permanent Man -Made Structures
When mining operations will adversely affect the stability of any significant, valuable and permanent
man -made structure located within 200 feet of the affected area, the applicant may either:
(a) Provide a notarized agreement between the applicant and the person(s) having an
interest in the structure, that the applicant is to provide compensation for any damage
to the structure; or
(b) Where such an agreement cannot be reached, the applicant shall provide an appropriate
engineering evaluation that demonstrates that such structure shall not be damaged by activities
occurring at the mining operation; or
(c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility
letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed,
will have "no negative effect" on their utility.
6. Review of the Aerial Map, submitted in Exhibit C, indicates there could be structures, associated
with residences along Shelbe Lane, within 200 feet of the permit boundary as well as one residence
along CR 29. Please provide an updated list of structures and structure owners for all structures
within 200 feet of the proposed permit boundary. An Exhibit C map will also need to be provided
or updated regarding Rule
6.4.3(g), the owner's name, type of structure, and location of these structures.
