The location of this <br />berm hould be depicted on the Reclmation Plan Map. <br />Exhibit E — Map (Rule 6.3.5): <br />5. Within in the Mining Plan and the Lease Agreement, the Applicant mentions mined material will be hauled <br />to a batch plant for processing. Please clarify the proposed batch plant location and depict this on the Mining <br />plan Map if this is near the vicinity of the permit boundary. Height <br />6. The Exhibit B Site Description states that Spring Creek, a dry drainage, runs through the northern side of <br />the permit. Please depict the flow line of Spring Creek on the Mining Plan and Reclamation Plan maps. <br />7. The Reclamation Plan Map is lacking the entire permit boundary. Please submit an updated map showing <br />the entire permit boundary, including the area permitted northeast of the pit for the access road. <br />Exhibit F — List of Other Permits and Licenses Required (Rule 6.3.6): <br />8. The Applicant stated that a CDPHE Stormwater Permit will be obtained. Please commit to providing the <br />Division with copies of the issued permit. <br />Exhibit H — Municipalities Within a Two -Mile Radius (Rule 6.3.8): <br />9. Under the requirements of Rule 6.3.8 please list the mailing address and telephone number of the <br />governing body for Vona, CO. <br />Exhibit L — Permanent Man -made Structures (Rule 6.3.12): <br />Where the mining operation will adversely affect the stability of any significant, valuable and permanent man- <br />made structure located within two hundred (200) feet of the affected land, the applicant may either: <br />a. provide a notarized agreement between the applicant and the person(s) having an interest in the structure, <br />that the applicant is to provide compensation for any damage to the structure; or <br />b. where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining <br />operation; or <br />c. where such structure is a utility, the Applicant may supply a notarized letter, on utility letterhead, from the <br />owners) of the utility that the mining and reclamation activities, as proposed, will have "no negative effect" <br />on their utility. <br />10. The application indicates that the access road enters directly onto County Road U. The structure, CR U, is <br />not listed in Exhibit L. Please update the structure list and comply with Rule 6.3.12. <br />Please note that any changes or additions to the application on file in our office must also be reflected in the <br />public review copy, which was placed with the Kit Carson County Clerk and Recorder by the Applicant. The <br />Applicant shall submit proof that any changes or additions to the application have been added to the copy placed <br />at the Clerk and Recorder's Office. <br />The application will not be considered submitted until the information listed above is received and found sufficient <br />to begin our review. Castle Rock Construction Company of Colorado, LLC has sixty (60) days from the date of this <br />letter to submit all necessary documents that the Office needs for the application to be considered filed. If, at the end <br />of the sixty day period, the application has not been determined to be filed with the Office, the Office shall deny the <br />application and terminate the application file. <br />
