Racine Circle <br />Centennial, CO 80111 <br />Re: Clapper Sand Pit, Permit No. M- 2015 -010, Receipt of 111 Construction Materials Special Operation <br />Reclamation Permit Application, Incompleteness Letter <br />Dear Mr. Bell, <br />On March 12, 2015, the Division of Reclamation, Mining and Safety (Division) received the Construction Materials <br />Reclamation Permit Application package for the proposed Clapper Sand Pit, Permit No. M- 2015 -010. Review of <br />this application determined the following items must be received before the Division can consider the application as <br />being submitted and the technical review can begin. <br />Exhibit K — Terms of Governmental Contract (Rule 6.3.11): <br />1. The Applicant listed that the Colorado Department of Transportation (CDOT) contract between Castle Rock <br />Construction Company of Colorado, LLC and CDOT, CDOT Form 85A, dated 2015 as being attached. In <br />addition, CDOT Form 85 Performance Bond and CDOT Form 85 Payment Bond were listed as being <br />attached. These three documents were not included in the application. Please submit these three documents. <br />The above item ( #1) will need to be submitted as soon as possible for the Division to call the application complete. <br />The following items ( #2 -10) were identified as inadequacies during a preliminary review of the application. <br />Responses to the following items will not be required for the Division to call the application complete, but will be <br />included in, but not limited to, the formal adequacy review of the permit following completeness. <br />Exhibit C — Mining Plan Rule (6.3.3): <br />2. The Applicant states that the topsoil of the disturbed portions of the pit will be stripped to a depth of 4 -6 <br />inches. Please commit to stripping the topsoil from the location of the access road as well. Additionally, <br />please recognize that the overburden stockpile will be a disturbed portion of the pit and commit to stripping <br />topsoil in the proposed area of the stockpile's footprint. <br />3. Under the requirements of Rule 6.3.3.(k), please state if refuse and acid or toxic producing materials will be <br />exposed during mining. If these will be exposed, please describe how they shall be handled and disposed of <br />in a manner that will control unsightliness and protect the drainage system from pollution. <br />Exhibit D — Reclamation Plan (Rule 6.3.4): <br />4. Within the Reclamation Plan, the Applicant discussed possibly constructing a berm along the northern <br />side of the mining area to prevent ersoion.
