KC owns an overhead power line that runs east -west <br />on the south side of CRU in the same vicinity. Crossing under the overhead power line at <br />the above referenced location will be required by highway type haul units and it is a <br />requirement of the 11 l Mining Permit that this permission be granted for any facilities <br />within 200' of the operation. This permission is granted for a two year period from the <br />date written above. <br />In consideration of such permission granted, CRCC agrees to indemnify and hold <br />harmless KC Electric any and all damages, claims, causes of actions or losses arising <br />directly out of CRCC's access to stated properties. <br />This letter agreement shall be binding when executed by both parties. <br />C Electric <br />
