COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />March 6, 2015 <br />Kym Schure <br />12826 CR 37 <br />Sterling, CO 80751 <br />Re: Dollerschell Pit, Permit No. M- 1986 -074, Receipt of 112 Construction Materials Reclamation Permit <br />Conversion Application Package (CN -01), Incompleteness Letter <br />Dear Mr. Schure, <br />On March 5, 2015, the Division of Reclamation, Mining and Safety (Division) received the Construction Materials <br />Reclamation Permit Conversion Application package for the Dollerschell Pit, Permit No. M- 1986 -074. Review of <br />this application determined the following items must be received before the Division can consider the application as <br />being submitted and the technical review can begin. <br />Application Form <br />1. The Division believes the Primary Mine Entrance Location provided on the application question #10 is <br />incorrect. Based on a Google Earth image, the location is actually 130 feet to the west of the coordinates <br />provided. Please provide a new application page 2 with the correct coordinates or provide proof that the <br />coordinates listed are correct. <br />6.4.14 Exhibit N — Source of Legal Right to Enter <br />2. The Applicant stated that the property is owned by Kym Schure and attached deeds provide ownership. The <br />Division could not locate the attached deeds. Please submit the deeds that show Kym Schure as the owner of the <br />affected land. <br />After review of Logan County Assessor records, the Division believes a portion of permit (northwest corner) is <br />owned by Robert L and Deborah G Hradecky. The application includes a signed letter from these individuals <br />stating that Kym Schure is the mineral rights owner of their property and he has right of access and egress. If the <br />Division is correct, please update the application question #7 to indicate this additional surface owner as well as <br />updating the list within Exhibit O. Additionally, the map provided in Exhibit C will need to be updated to reflect <br />this change. <br />6.4.15 Exhibit O — Owner(s) of Record of Affected Land (Surface Area) and Owners of Substance to be <br />Mined <br />4. As mentioned in incompleteness item #3, Robert L and Deborah G Hradecky could have ownership of lands <br />within the affected area. If this is incorrect, they may own lands within 200 feet of the.affected area and will <br />need to be listed as an adjoining property owner. <br />5. Additionally, the Logan County Assessor records indicated a Bany Land LLC as the owner of the property to <br />the east of the permit.
