EXHIBIT C <br />ADDITIONAL SUBJECT SITE RECLAMATIONREQUIREMENTS <br />In addition to all reclamation requirements under Kirkland's Division of Reclamation Mining <br />and Safety permit and applicable law, Kirkland shall reclaim the Subject Site in accordance with <br />the following: <br />I. General. <br />A. Sensitive Features. Identify and avoid sensitive environmental features such as <br />riparian areas, meadows, wetlands, unique habitats, etc. <br />B. Surface Disturbance. Limit development to gentle terrain and minimize the <br />amount and extent of surface disturbing activities, and remove only the minimum amount of <br />vegetation necessary for the construction of road and facilities permitted on the Subject Site and <br />Property. <br />C. Visibility. Avoid areas in view of sensitive viewpoints and minimize visibility of <br />project features. <br />D. Extent of Development. Limit the size and impact of the development. <br />E. Protection of Resources. Take all reasonable steps to prevent operations from (A) <br />polluting wetlands, waters of reservoirs, springs, ditches, streams, or existing wells located on or <br />near the Subject Site or Property, (B) damaging crops, timber, or pastures, (C) harming or <br />injuring wildlife or livestock, and (D) emitting noise or light considered harmful or intrusive to <br />surrounding human or wildlife habitats. <br />F. Access and Safety. Limit the number of persons and vehicles, establish and <br />enforce strict safety rules, and takes steps to prevent fire and to promptly extinguish any fire. <br />G. Monitoring. Establish and maintain and comprehensive monitoring program to <br />identify and address any adverse effects. <br />II. Site Preparation, Pre - processing. <br />A. The affected area for reclamation will consist of the aggregate processing site, any <br />stockpile areas, any access road to the aggregate processing site, and any temporary office or <br />staging areas. <br />B. All processed materials not required for the Operations and which will be <br />disposed of and /or saved within the Subject Site, including spoil piles and/or topsoil, shall be <br />handled in such a manner so as to prevent any unauthorized release of pollutants to the surface <br />drainage system and will be stabilized and protected to prevent any erosion or siltation. <br />20 <br />
