Please clarify this discrepancy and provide the Division with a copy of <br />the NOI which was submitted to the USFS. <br />4. The Applicant has stated no new roads would be constructed and no upgrades to existing roads would <br />be required to access the site. However, the proposed plan calls for repairing and improving any road <br />damage caused by the operation. Pursuant to Rule 5.1.2 the estimated acreage of land surface to be <br />disturbed by prospecting activities shall include areas disturbed by access routes. It should be noted <br />that reclamation which must be performed on the access route must be accounted for in the financial <br />warranty to be held by the Division. Please specify the portions of the access route which may require <br />repairs or upgrades and revise the size of the area to be disturbed. <br />5. The mine dump appears to be situated on both sides of Lion Creek Road. Please specify if sampling <br />of the mine dump will occur on both side of the road. ° <br />6. Please specify the gradient of the proposed prospecting site. In addition, describe what measures will <br />be taken to control erosion of the mine dump so that areas outside of the affected land are protected. <br />7. The NOI calls for reclaiming the site using best practices in mycorrhizal remediation. Please provide <br />further detail on the specific phytoremediation process to be employed. In addition, specify the <br />intended goal of using phytoremediation techniques, i.e. removal or stabilization of metals. Since the <br />mine dump will remain following sampling, the Applicant should specify if mycorrhizal remediation <br />will be performed across the entire mine dump or only on the portions where trenching occurs. <br />Finally, the Applicant should provide the Division with the costs associated with mycorrhizal <br />remediation as these costs will be incorporated into the financial warranty to be held by the Division. <br />8. Please specify how the proposed trenches will be excavated and describe how the Applicant will <br />ensure the footprint of the mine dump is not increased as a result of excavation. In addition, specify <br />how the material will be transported from the site and include a plan that addressed the handling of <br />the material and how any potential spills of the mine dump will be cleaned up. <br />9. As required by Hard Rock Rule 5.3.1(f), please describe how the proposed trenches will be <br />safeguarded from unauthorized entry at all times as necessary to provide for public safety. <br />10. The Applicant has stated minimal vegetation will be disturbed as a result of the prospecting activities. <br />However, the Applicant has not provided a seed mixture to be used in the re- establishment of <br />vegetation. Pursuant to Hard Rock Rule 5.5.2(e), if vegetative cover was destroyed, an appropriate <br />seed mix shall be used in the first normal period for favorable planting. Please specify if there is <br />vegetation around the perimeter of the dump which will be disturbed or destroyed as a result of <br />prospecting activities. If so, then please specify the seed mixture to be used in the re- establishment of <br />vegetation and describe the methods for seed bed preparation and application method for grass <br />seeding. <br />11. The proposed prospecting operation will disturb a mine dump rich in sulfide minerals which has been <br />undisturbed for a prolonged period of time and may have developed a hardened crust that is more <br />resistant to weathering than newly exposed material. The newly exposed material will potentially be <br />more prone to weathering and leaching. Please specify how all acid - forming materials will be handled <br />so that the drainage system is protected from pollution. The response should address how stormwater <br />
