Hays, and To Whom It May Concern; <br />My name is Marcos Hernandez, and my wife's name is Maria de Lourdes Palma. We are <br />the current legal property owners of the property located at 160 -N 1" Avenue, Greeley, <br />Colorado 80631 (the subject property). We purchased this property on May 17, 2010. We have <br />never occupied the property. We currently have the property leased out as a single family <br />residence. The only source of domestic water for the residence is a domestic deep water well <br />that sits on the property. We are currently experiencing problems with the water level in our <br />well and we feel that outside influences might be the cause of the problem. It is our desire that <br />you help us find the cause of the problem, and help us to arrive at a peaceful solution. <br />In May, 2010, when we purchased the subject property, we became aware of an open <br />pit mine approximately three hundred yards to the east of our property. It is my <br />understanding that the open pit mine is a sand and gravel extraction operation. The water that <br />rises to the surface as the gravel is being mined is diverted away via a channel that has been <br />dug for that process. At the time that we purchased the subject property, Mill Iron Mining, was <br />operating the mine, and extracted sand gravel from the open pit mine on an as needed basis. <br />Today, with the advent of the increased activity for oil extraction through the process <br />known as hydraulic fracturing (fracking), and, with the increased demand for sand and gravel <br />needed in the fracking process, the owners of Mill Iron Mining now have the mine working on a <br />daily basis. The residual effect being; in my opinion, the level of the water that feeds our well <br />has significantly dropped, and is therefore affecting the supply of water to our well. <br />Prior to November 2014, we had never encountered any problems with our domestic <br />well, and the capacity of said well to meet the demands of our tenants at the subject property. <br />For example; there has always been plenty of water for domestic use such as, cooking, bathing, <br />washing. In addition, the well also provided sufficient water for outside use i.e. watering the <br />lawn and garden (I have a functioning automatic sprinkler system), and washing automobiles. <br />RECEIVED <br />1(AR 0 4 2015 <br />DNOW OF RECLAWTION <br />MMMGMIMISAFM <br />
