The Division received comments from the Colorado Historical Society, the Colorado <br />Division of Water Resources and Colorado Parks and Wildlife. The letters are attached for <br />your review. Please address the comments noted in the letters, and make any changes in the <br />application as necessary. <br />Application Form <br />3. The Certification Page (pg. 7) of the Application Form was incorrectly completed. The <br />`Applicant/Operator' field should contain the name of the Applicant (Nevadaville Encore, <br />LLC), rather than the name of the authorized representative. This page must be revised and <br />with signatures verified by a Notary Public. A copy of the Certification Page has been <br />attached for your use. <br />6.3.1 Exhibit A — Legal Description and Location Map <br />No comment. <br />6.3.2 Exhibit B — Site Description <br />No comment. <br />6.3.3 Exhibit C — Mining Plan <br />4. The Applicant has stated crushing, grinding and screening of the ore may take place on site. <br />As required by Rule 6.3.3(1)(m), please a brief description of the proposed processing. The <br />process area and any structures must be described on the Mining Plan Map. <br />5. The Mining Plan states "No structures exist on or within two hundred (200) feet of the <br />proposed mine site ". However, Exhibit L identifies an XCEL powerline within 200 feet of <br />the proposed operation. Please submit a revised Mining Plan with the above referenced <br />statement removed. <br />6. As required by Rule 6.3.3(1)(a), please specify the estimated dates that mining will <br />commence and end. <br />7. As required by Rule 6.3.3(1)(f), please specify the dimensions (volume) of waste rock which <br />is present at the site. <br />The Applicant has stated up to 500 gallons of water will be stored in a tank on -site. As <br />required by Rule 6.3.3(1)(h), please specify the source of this water and clarify if 500 gallons <br />is the total amount of water to be used or the total amount to be stored. If more than 500 <br />gallons will be used in conjunction with the operation, then specify this amount. In addition, <br />specify how the process water will be disposed. <br />
