PERMIT #: M- 1995 -095 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: February 12, 2014 <br />OBSERVATIONS <br />This inspection was conducted as part of the regular monitoring program. Mr. Henry Schuler was present for <br />the inspection, representing the Operator (Schuler Terracing). This is a 110c construction material mine. The <br />mine was not operating at the time of the inspection. <br />The Simla Highway Pit entrance is located approximately 3 miles south of Simla off the Simla Hwy (Co. Rd 125). <br />Inspection: <br />Most of the site was covered with a few inches of snow. A permit sign was posted at the site entrance (see <br />Photo 1). The site is fenced all the way around. A stormwater pond was observed in the northeast corner of <br />the site (see Photo 2). Mr. Schuler indicated stormwater typically infiltrates in 72 hours or less. <br />Mr. Schuler stated he has stripped and stockpiled topsoil material on the west side of the pit (see Photo 3) for <br />reclamation. He has also a small stockpile of manure from local stockpens for fertilizing reclaimed areas (see <br />Photo 4). The northwest area of the pit has been graded to final contours (which appeared to be 3H:1V or <br />flatter), topsoiled and seeded (see Photo 5). Given the snow and the time of year, it was difficult to determine <br />how well the vegetation was established. (Note: A review of historic Google Earth images indicates <br />reclamation in this area was initiated sometime between 2006 and 2010.) <br />Mr. Schuler indicated no processing is required for the Class III material he produces, other than some on -site <br />blending of materials. A small concrete rubble pile (see Photo 6) was observed in the southwest corner of the <br />site. Mr. Schuler indicated this material is used for wash -out repairs. <br />No wildlife impacts or noxious weed were observed. <br />Records: <br />• The total permitted area is 9.9 acres with the approval of Amendment 1 in 2003, adding 3.9 acres to <br />the permit. <br />• The permit was transferred (Revision SO -01) to Schuler Terracing from El Paso County 12002. <br />• The previous inspection was performed on 2/27/2009. No problems were cited. <br />• The anniversary date is July 8. Annual reports and fees are current through 2014. <br />1. The 2013 annual report indicated 9.9 acres had been affected. The 2014 annual report (not <br />available at the time of this inspection) indicated only 2.5 acres have been affected, and that <br />2.5 acres have been backfilled and seeded. <br />2. The DRMS has no record of an acreage release being requested, which is required to reduce <br />affected area. The discrepancy in affected area and DRMS records is cited as a potential <br />problem on page one of this report <br />• The post -mine land use is rangeland. <br />Current Stipulations: None. <br />Bond: <br />The current bond is inadequate for 9.9 acres of affected area. The Operator must request a surety reduction <br />for reclamation performed or an acreage release for reclamation completed on affected area where there is to <br />Page 2 of 7 <br />
