The bottom and sides of the ditch are designed to be composed of soil but there may be <br />some rock fragments from the rock ledge in the soil. The construction of pond 002 north ditch did not go beyond <br />the stream buffer zone signs of Meehan Draw (photo 7). <br />The stream buffer zones signs were still in place along Nygren Draw. These signs are less than 100 feet from the <br />draw. WFC needs to apply for a stream buffer zone variance for this area or demonstrate that Nygren draw has <br />less than a 1 square mile drainage area and does not warrant stream buffer zone protection as outlined in Rule <br />4.05.18. <br />Water was being pumped to pond NHN -001 from the main pit. Pond NHN -001 contained some water but was not <br />discharging. The discharge and outlet structures were free and clear of obstructions (photo 8). <br />SIGNS AND MARKERS — Rule 4.02: <br />Permit boundary signs were in place by the pond 001 discharge /flume structure and along the access road <br />to the NH1 pond. <br />TOPSOIL — Rule 4.06 <br />Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3; Redistribution 4.06.4: <br />Topsoil was salvaged for the construction of the Pond NHN -002 north ditch. The topsoil through this area <br />varied in depth from 1 to 7 feet thick (photo 9). In areas where the topsoil was deep, a large vertical wall of <br />topsoil remained that was susceptible to erosion. To protect the topsoil from erosion, WFC backfilled some bench <br />1 material from the ditch construction up against the vertical wall of topsoil (photo 10 & 11).
