Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />N - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a partial inspection of the New Horizon North Mine conducted by Brock Bowles of the Colorado <br />Division of Reclamation Mining and Safety. Frank Ferris of Western Fuels- Colorado was present for the entire <br />inspection. The weather was clear and cool with no wind. The gound conditions were dry and coal was not being <br />hauled from the mine site. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />Technical Revision 8 was available for public review at the Montrose County Courthouse Annex- Nucla. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The east and west ditches of Pond 001 were inspected. These ditches have been the subject of NOV- <br />2014 -004 as it was not built to the specifications of Map 2.05.3(4) -7 NHN -001 Ditches As- Built. During the Jan <br />13, 2015 inspection, WFC measured the ditch using a Trimble GPS and noted that ditch segments West 3, East 2 <br />and East 4 continued to be out of compliance. Since then, these ditch segments had new geo -web with rock <br />installed (photos 1, 2 &3). The geo -web was installed on the ditch sides higher than the adjacent segments with <br />anchors through every other web. The cross sections that were repaired were 16 feet across and 28 inches deep. <br />This equates to 14.7 square feet of available flow cross section area which well exceeds the minimum <br />requirements required by Map 2.05.3(4) -7 NHN -001 Ditches As- Built. The ditches for Pond NHN -001 east and <br />west are now considered to be constructed to the specifications of Map 2.05.3(4) -7 and NOV- 2014 -004 will be <br />terminated. <br />Pond 002 was being constructed. The embankment and discharge structures were being installed (photos 4 & 5). <br />The north ditch was also being constructed where a 18 " -24" rock layer was encountered during excavation (photo <br />6).
