REPLACEMENT SOURCES <br />Replacement water for the Worthing Pit depletions at the South Platte River will be provided by <br />leased water from the City of Aurora, Colorado. On May 17, 2011, AFS executed an agreement <br />with the City of Aurora for Lease of Firm Delivery of Reclaimed Wastewater. The 2011 lease <br />agreement was amended June 13, 2011. Copies of the executed documents are provided in the <br />Attachments. The lease agreement is for the release of up to a total of 20.0 acre -feet of water <br />per year for a period of approximately five years from February 1, 2011 through December 31, <br />2015. The leased water is fully consumable effluent released from the Metro Wastewater <br />Reclamation District Treatment Facility (a.k.a. Robert W. Hite Facility or Hite Plant). <br />Aurora will deliver the water to the river as effluent from the Hite Plant located approximately <br />12 miles upstream of the mining operation. AFS will assess a transit loss of 6 percent (0.5 <br />percent per river mile) to the deliveries made by Aurora and used to augment the Worthing Pit <br />depletions. As part of this SWSP renewal process, AFS has provided the City of Aurora with a <br />revised delivery schedule for the depletions associated with the 2015 plan year in the amounts <br />shown in Table 5, Column 6. An acknowledgement email from Aurora is included in the <br />Attachments. <br />D. OPERATION OF PLAN <br />AFS will submit monthly accounting and reporting sheets for depletions and replacements to the <br />Division Engineer and water commissioner. A detailed accounting sheet providing monthly <br />estimates of all applicable items is provided in the Attachments. <br />Long -Term Operation <br />AFS will maintain the SWSP for Worthing Pit until backfilling and reclamation is complete. <br />Upon final reclamation of Worthing Pit, the total exposed ground water surface area of the <br />remaining lake will be less than the pre -1981 exposed water surface area (28.00 acres) as shown <br />in Figure 4. Because all post -80 area will be backfilled within 2015, AFS does not expect filing <br />for any additional SWSP's beyond the 2015 plan year. <br />ACKNOWLEDGEMENT OF POTENTIAL REVOCATION <br />AFS acknowledges an approved substitute water supply plan may be revoked or modified at any <br />time should it be determined that injury to other water rights has or will occur as a result of the <br />approved plan, or if the applicant has violated any term and condition contained in this or any <br />prior plan. <br />
