East Mine portals and facilities area, the West Mine portals and facility area and the <br />Bleeder Entry area. These three areas are all located along Old Colorado Highway <br />133 approximately 12 miles northeast of the town of Paonia, Colorado and 3 miles <br />east of the town of Somerset, Colorado adjacent to the North Fork of the Gunnison <br />River. The three disturbed areas are located within one mile of each other. The <br />disturbed and reclaimed areas are located in portions of Sections 1, 2, 3, 10, 11 and <br />12, Township 13 South, Range 90 West of the 6th P.M. <br />Lands included in the Termination of Jurisdiction Process <br />A total of 29.4 acres were disturbed at the Hawk's Nest Mine within a permit area of <br />2,050.0 acres. At the East Mine 15.0 acres were disturbed and reclaimed, at the West <br />Mine 14.0 acres were disturbed and reclaimed and at the Bleeder Entries 0.4 acres <br />were disturbed and reclaimed. This TOJ Findings Document is for all 29.4 reclaimed <br />acres within the 2,050 acre permit area and also includes any land areas overlying the <br />underground workings of the Hawk's Nest Mine. <br />Dollar Amount of Bond to be Released <br />The Hawk's Nest Mine is a permit revocation/bond forfeiture site. The Division used <br />all of the forfeited bond money to complete reclamation activities at the Hawk's Nest <br />Mine. Since all of the bond money was spent on the reclamation of the site, there will <br />be no money returned to the operator as a result of this TOJ process. <br />II. BACKGROUND OF THE HAWK'S NEST EAST AND WEST MINES <br />Initial Permitting History, Permitting Revocation and Bond Forfeiture <br />The area has an extensive history of mining. The Hawk's Nest Mine was originally <br />permitted by Western Slope Carbon, Inc. (the operator) under Extraction and <br />Development Permit No. 78 -155, issued by the Colorado Mined Land Reclamation <br />Board (Board). On March 14, 1983 the Division proposed its decision to Approve <br />with Conditions the Hawk's Nest Mine permit and on June 7, 1983 it issued <br />permanent program Permit No. C- 1981 -016 to Western Slope Carbon, Inc. On <br />December 14, 1988 the Board revoked the Hawk's Nest Mine permit and forfeited <br />the reclamation bond (in the amount of $624,803.05) due to a pattern of violations. <br />Site Reclamation History <br />The Division, using private contractors and acting under the authority of the Board, <br />began reclaiming the site in 1990. The initial reclamation was completed at the West <br />Mine. Reclamation work included demolition and removal of structures, the <br />backfilling and sealing of six portal entries, the backfilling and regrading of the <br />disturbed area and the revegetation of the disturbed area. The work at the West Mine <br />was completed in November 1990.
