INTRODUCTION <br />Introduction <br />Background of the Hawk's Nest East and West Mines <br />Criteria and Schedule for Bond Release <br />Observations and Findings <br />Summary <br />Proposed Decision <br />Purpose of this Document <br />This document presents the findings of compliance and the proposed decision of the <br />Colorado Division of Reclamation, Mining, and Safety (Division) for Termination of <br />Jurisdiction (TOJ) at the Hawk's Nest East and West Mines, Permit No. C- 1981 -016. <br />The Hawk's Nest Mine is a permit revocation/bond - revoked site. The permit area <br />under consideration for termination of jurisdiction and final liability release is 2,050 <br />acres of which 513.0 acres were affected and 29.40 acres were disturbed and <br />subsequently reclaimed. The surface ownership is both Federal and private, with <br />1,537 Federal acres and 513 private acres. The mineral ownership is Federal, with all <br />2,050 acres of mineral estate being Federal. This termination of jurisdiction process <br />was initiated by the Division following completion of the required minimum ten -year <br />liability period for reclamation and revegetation of the disturbed area including two <br />years of vegetation sampling at the site. <br />Background Information Sources <br />The Division will follow the requirements for review, public notice, and public <br />participation as required for a bond release application in Accordance with Rule 3.03. <br />Detailed information about the bond release review process can be found in the <br />Colorado Surface Coal Mining Reclamation Act, the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining, and in the Guideline Regarding <br />Selected Coal Mine Bond Release Issues, dated April 18, 1995. Detailed information <br />about mining and reclamation operations at the Hawk's Nest Mine can be found in <br />mining and reclamation permit application C- 1981 -016 and associated records on file <br />at the Division offices, located at 1313 Sherman Street, Room 215, in Denver, <br />Colorado. <br />Location of Areas Under Consideration for Termination of Jurisdiction <br />Three discrete disturbed and reclaimed areas are included in this TOJ process, the <br />Hawk's Nest East and West Mines Termination of Jurisdiction (SL -01) <br />C- 1981 -016 February 24, 2015 <br />
