December 9, 2002 <br />Mr. Bill Rodman <br />3613 F Street <br />Greeley, CO 80631 <br />AGGREGATE <br />INDUSTRIES <br />Re: Greeley West Operations (83*d Joint Venture Property) — Gravel Mine Well Permit <br />Dear Bill: <br />By letter of October 3, 2002 Aggregate industries requested your signature on a new well spacing <br />statement in association with a new well permit application for the above - referenced operation. In <br />support of this request, we affirmed responsibility and commitment to fulfilling the terms of an agreement <br />provided to you by 83a Joint Venture with regard to assuring that you would be supplied with water if <br />there are any impacts to your well from injury due to aning. <br />Your response letter ofNovember 22, 2002 requests that Aggregate Industries specifically state that the <br />pump at the replacement well already provided to you will be upgraded to give you the pumping capacity <br />of your original well when the water level rises in the mined ponds. When Mike McAfee and i ]net with <br />you on October 3, Mike agreed that our commitment extends to this provision. Please accept this letter as <br />written confirmation of that specific commitment as well as our commitment to continue to provide you <br />with make -up water from the 83 d Joint Venture property until such time as original pumping capacity is <br />re- established. <br />Thank you again for your time and consideration in this matter. Please call me if you have any further <br />questions.
