King Coal Mine; MT7 <br />Page 3 <br />January 5, 2015 <br />Section 2.03.7 for the King I Mine states, "No dwelling sites are located on or within 300 feet except the <br />Mark and Julie Crawford residence as shown on Maps King I -005 and King 1-013." I assumed this means <br />the identified residence is within 300 feet of mining. Based on Map King I -005, a buffer has been placed <br />around this residence and underground mining has occurred outside of the buffer area. However, it does <br />not appear surface mining activities; surface operations or facilities for the King I Mine are within 300 <br />feet horizontally of the occupied dwelling so Rule 2.03.7(3) does not appear to apply. Section 2.03.7 for <br />the King II Mine indicates that there are no occupied dwellings on or within 300 feet of the permit area. <br />• Please update section 2.03.7 of the King I mine to clarify the flowing statement found in this section, <br />"No dwelling sites are located on or within 300 feet except the Mark and Julie Crawford residence as <br />shown on Maps King I -005 and King 1-013." <br />2.03.8(1) -(3); Permit Term Information <br />Rule 2.03.8(1) does not apply as this is an underground mine. <br />The permit contains two sections titled 2.03.8 — Permit Term Information, one for the King I mine and <br />one for the King II mine that address Rule 2.03.8(2). According to these sections of the permit the <br />anticipated start of each phase of the mining activities is discussed in section 2.05.2 and 2.05.3 of the <br />permit. Section 2.05.2 of the permit indicates the King I Mine started in 1941 and ended in 2009, <br />however Section 2.05.2 for the King II permit only states the expected life of the mine is 6 to 9 years. <br />The actual start date and anticipated termination date of the King II mine is not stated. Sections 2.03.8 of <br />the permit indicates the surface disturbance of the King I Mine and King II Mine will be 10.88 -acres and <br />22.36 -acres respectively. Section 2.03.8 of the permit indicates the extent of the underground mining at <br />the King I and II mine will be 2049.15 -acres and 295.5 -acres respectively for the 5 year permit term and <br />for the life of the operation. The vertical extent of the mine workings is discussed in sections 2.05.3 of <br />the permit. <br />The King Coal Mine has not been approved to conduct operations for greater than a 5 year term so Rule <br />2.03.8(3) does not apply. <br />Section 2.05.2 for the King II mine states the expected life of the mine is 6 to 9 years. The actual start <br />date and anticipated termination date of the King II mine is not stated. For the King II mine, in <br />Section 2.03.8 of the permit, please indicate the actual starting date of the mine and the anticipated <br />termination date of the mine in accordance with Rule 2.03.8(2). <br />2.03.9(1) -(4); Insurance Information <br />The permit contains two sections titled 2.03.9 — Personal Injury and Property Damage Insurance <br />Information, one for the King I mine and one for the King II mine. These sections indicate that the <br />applicant has a public liability insurance policy in effect in accordance with Rule 2.03.9(1). The copy of <br />the public liability insurance policy certificate is located in Appendix 14 of the permit and expired on <br />
