Based on the Division's files the last copy of the certificate we received expired on <br />09/01/2014. <br />• Please revise Appendix 14 and submit a current and active copy of the public liability insurance <br />policy certificate in accordance with Rule 2.03.9(1). <br />• In accordance with Rule 2.03.9(3), please ensure the policy includes a rider requiring that the insurer <br />notify the Division whenever substantive changes are made in the policy, including any termination <br />or failure to renew. <br />2.03.10(1) -(4); Other Licenses and Permits <br />Two sections of the permit are titled 2.03. 10 — Identification of Other Licenses and Permit, one for the <br />King I mine and one for the King II mine. Each section contains a list of licenses or permits the applicant <br />indicates they need to conduct the underground mining activity. Each item listed contains all of the <br />required information from Rule 2.03.10(1) -(4) with one exception. <br />• Please revise sections 2.03. 10 of the permit to indicate the identification number of the Class II <br />Special Use Permit in accordance with Rule 2.03.10(3). <br />2.03.11; Public Filing of Permit <br />Two sections of the permit are titled 2.03.11 — Identification of Location of Public Office for Filing of <br />Application. These sections include the information required by Rule 2.03.11. <br />2.06.2; Experimental Practices Mining <br />The King Coal Mine is not approved to conduct Experimental Practice Mining. <br />2.06.8; Surface Coal Mining and Reclamation Operations on Areas, or Adjacent to Areas, <br />Including Alluvial Valley Floors <br />Two sections of the permit are titled 2.06.8 — Alluvial Valley Floors, one for the King I mine and one for <br />the King II mine. Hay Gulch and Pine Gulch are located within the permit area. Hay Gulch has been <br />determined to be an alluvial valley floor. It was found that Pine Gulch does not qualify as an alluvial <br />valley floor. According to Section 2.06.8 of the King I permit, only the .92 -acre access road leading to <br />the mine bench is located within the Hay Gulch alluvial valley floor. This was a pre- existing roadway. <br />The King II mine is not approved to affect the Hay Gulch alluvial valley floor with the exception of the <br />installation and utilization of a monitoring well. The application content required by Rule 2.06.8(4) for <br />operations affecting alluvial valley floors is located throughout the permit in sections 2.04.3, 2.04.5 to <br />2.04.10 and Appendix 004. Based on this information and the operations plan, in accordance with Rule <br />2.06.8(5)(a) the Division has found the following according to the Permit Renewal No. 6 Findings <br />
