bond, less than the maximum of 60 %. <br />Reclamation work which remains to be done at the site includes removal of temporary culverts, <br />sealing of monitoring wells and backfilling and grading of the remaining sediment pond for <br />Phase I. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice <br />in the The Daily Sentinel as soon as possible. Requests for public hearing must be submitted to <br />the Division in writing within thirty days of the first publication in the The Daily Sentinel. If no <br />hearing is requested within those thirty days, the Division's decision will become final. <br />PHASE II <br />Based on the observations above, the Division proposes to release a total of $19,228.77 of bond <br />for the Phase II request of SL -2. Based on the total applicable bond of $263,445.00 held prior to <br />SL -1, the total amount of released liability including SL -2 for Phase II will be $19,228.77 for the <br />Munger Canyon Mine. See Table 5. As per Rule 3.03.1(2)(b), up to 85% (60% Phase I and 25% <br />Phase II) of the applicable bond amount shall be released upon the establishment of vegetation <br />which supports the approved post- mining land use and which meets the approved success <br />standard for cover, and meets applicable productivity standards for prime farmlands, alluvial <br />valley floors or croplands. The total amount of proposed releasable liability for Phase II bond <br />release equals to 7.3% of the total applicable bond, less than the maximum of 25 %. <br />Reclamation work which remains to be done at the site includes sealing all monitoring wells, <br />reseeding remaining mine areas pending failure, replace topsoil to remaining disturbance on <br />waste pile, reseeding remaining disturbance on refuse pile and reseeding the sediment pond for <br />Phase II. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice <br />in the The Daily Sentinel for two weeks as soon as possible. Requests for public hearing must be <br />submitted to the Division in writing within thirty days of the first publication in the The Daily <br />Sentinel. If no hearing is requested within those thirty days, the Division's decision will become <br />final. <br />PHASE III <br />Based on the observations above, the Division proposes to release a total of $3,540.00 of bond <br />for the Phase III request of SL -2. Based on the total applicable bond of $263,445.00 held prior to <br />SL -1, the total amount of released liability including SL -2 for Phase III will be $3,540.00 for the <br />Munger Canyon Mine. See Table 6. As per Rule 3.031(2)(c), the remaining portion of the bond <br />amount (15% Phase III) shall be released when the permittee has successfully completed all <br />surface coal mining reclamation operations in accordance with the approved reclamation plan, <br />
