2. In the section seed mix/seeding methods (page 5 -8) it states that the goal of the seed
mix is "to establish a vegetation cover adequate to control erosion... prior to final
development of the property." Please amend this sentence so it reflects the current post
mining land use.
The text on page 5 -9 of the APD has been revised to address the above concern.
3. The first paragraph in the Revegetation Success Criteria section (page 5 -9) references
the change in the primary post mining land use. The post mining land use has been
changed multiple times in the history of this mine and all of them have been discussed
in this revision. Please clarify which post mining land use is being discussed.
The text on pages 5 -9 through 5 -11 has been revised in the APD to address the history of post -
mining land uses and clarify that PR01 addresses the primary post- mining land use of dryland
pasture.
4. The permit text on page 5 -9 describes the reference area as 1.7 acres and Appendix 5-
14 describes it being 1.5 acres. Please clarify the acreage of the reference area.
The text in Appendix 5 -14 has been revised to be consistent with the APD text in this section.
5. Where the post mining land use is dryland pasture, the success standard will be that of
the proposed reference area. The text on page 5 -9 states that the proposed reference
area contains a mixture of pasture grasses, mountain shrub and pinyon juniper
vegetation communities. The reference area being proposed does not have the same
plant community as that of a dryland pasture. Rule 4.15.7(3)(a) states that a reference
area shall be selected to represent each plant community within the disturbed area.
Please explain why a mountain shrub and pinyon juniper vegetation community is
being proposed as a reference area for a dryland pasture.
The location and composition of the dryland pasture reference area was selected based on the
desires of CDRMS Senior Environmental Protection Specialist Sandra Brown in 2014.
6. Please include a discussion as to how the reference area will be managed especially as
it pertains to grazing and weed control (Rule 4.15.7(3)(d)).
Revised APD page 5 -11 contains an added discussion of dryland pasture reference area
management.
7. The permit text on page 5 -17 has the heading 2.05.5(2) Proposed Post - Mining Land
Use (2014). Rule 2.05.5(2) is actually about the post mining land uses for underground
mines. Please amend the nomenclature so it does not appear that underground mining
activities are being addressed. Also, please remove `Proposed' in the heading.
