The expected physical appearance of the area of the affected land, correlated to the <br />proposed mining and reclamation timetables. The map must show proposed topography of <br />the area with contour lines of sufficient detail to portray the direction and rate of slope of <br />all reclaimed lands; and <br />b. Portrayal of the proposed final land use for each portion of the affected lands. <br />EXHIBIT M - Other Permits and Licenses (Rule 6.4.13): <br />13) The text describing the french drain stated that the west side of the french drain may be located <br />within the Adams County road right -of -way; however, it appears that the proposed french drain <br />is inside the approved permit boundary. Will the Applicant/Operator need a permit to do work <br />within the permit boundary in the county road right -of -way? <br />EXHIBIT N - Source of Legal Right to Enter (Rule 6.4.14): <br />14) In review of the submittal, DRMS noticed that the temporary easement will only be valid for <br />approximately a year. Please be advised that the Applicant/Operator will need to maintain legal <br />right to enter on all lands affected by the installation of the french drain until the affected lands are <br />released from the permit. Affected lands cannot be released from the permit until the-Operator has <br />completed the approved Reclamation Plan and established vegetative cover in compliance with <br />Rule 3.1.10. Rule 3.1.10 states "In those areas where revegetation is part of the Reclamation <br />Plan, land shall be revegetated in such a way as to establish a diverse, effective, and long - lasting <br />vegetative cover that is capable of self regeneration without continued dependence on irrigation, <br />soil amendments or fertilizer, and is at least equal in extent of cover to the natural vegetation of <br />the surrounding area." DRMS believes that the revegetation may take a few years to complete. <br />Please demonstrate that the Applicant/Operator will maintain legal right to enter the area of the <br />temporary easement until the affected land has been released from the permit. <br />15) The text describing the french drain stated that the west side of the french drain may be located <br />within the county right of way; however it appears that the proposed french drain sits inside of <br />the approved permit boundary as approved in AM -01. Will the west part of the french drain sit <br />inside the permit boundary as approved in AM -01? <br />EXHIBIT R - Proof of Filing with County Clerk and Recorder (Rule 6.4.18): <br />16) The submittal for this exhibit did not demonstrate that a copy of the AM -02 application was placed <br />with the local County Clerk and Recorder for public review, as required by Rule 1.6.2(1)(c). <br />Please submit an affidavit or receipt indicating the date on which the application was placed with <br />the local County Clerk and Recorder for public review, as required by Rule 1.6.2(1)(c). <br />17) Please note that any changes or additions to the application on file in our office must also be <br />reflected in the public review copy, which was placed with the Adams County Clerk and <br />Recorder. <br />
